تجمع کارکنان قوه قضاییه در اعتراض به تصمیم مجلس

بخشی از کارکنان قوه قضاییه روزگذشته ۱۸ دی‌ماه در اکثر شهرهای کشور در اعتراض به ردطرح افزایش حقوق در مجلس شورای اسلامی دست به تجمع اعتراضی زدند.

در پی رد شدن کلیات طرح فوق‌العاده خاص کارکنان قوه قضاییه در جلسه علنی روز ۱۵ دی‌ماه مجلس شورای اسلامی، کارکنان این قوه روزگذشته با برگزاری تجمع‌هایی مراتب اعتراض خود را اعلام کردند.

تعیین فوق‌العاده خاص کارکنان قوه قضاییه در هفته‌های آخر ریاست سیدابراهیم رئیسی بر قوه قضاییه با نام طرح تسری فوق‌العاده خاص کارمندان سازمان زندان‌ها و اقدامات تأمینی و تربیتی کشور به کارکنان اداری قوه قضائیه در مجلس اعلام وصول شد و در کمیسیون اجتماعی مورد بررسی قرار گرفت.

این طرح از ابتدای تدوین آن مورد حمایت جدی رییس پیشین قوه قضاییه بود و حتی آنطور که معاون وقت منابع انسانی قوه قضاییه گفته است، با همکاری محمد مصدق، معاون اول فعلی قوه قضاییه تدوین شده است.اما میثم لطیفی رییس سازمان اداری استخدامی کشور که برای اعلام مخالفت دولت با طرح در مجلس حاضر شده بود، در جلسه صحن علنی مجلس گفت: ما در دولت نگران مطالبه همسان سازی حقوق و تسری سایر دستگاه ها بوده ایم و امکان دارد این وضعیت به سایر دستگاه ها منتقل شود و مطالبات جدیدخبرای سایر دستگاه ها ایجاد کند که باعث ایجاد نارضایتی خواهد شد.

شورای حقوق و دستمزد متولی امر حقوق است و باید براساس سختی شغل و حساسیت آن حقوق را تعیین کند. ما قبول داریم که قوه قضائیه در بحث حقوق مشکلات فراوانی دارد، اما باید از راه های دیگر به این وضعیت رسیدگی کرد تا نارضایتی سایر دستگاه را ایجاد نکند.

پس از رد کلیات طرح و آغاز زمزمه‌های اعتراضات کارکنان قوه قضاییه، معاونت منابع انسانی این قوه در نامه‌ای خطاب به کارکنان ضمن تشریح فرایند تدوین و پیگیری این طرح، رای منفی نمایندگان و اظهارات نماینده دولت درباره طرح را «خلاف تمام اصول اخلاقی» دانسته و در عین حال بر خودداری کارکنان قوه از «اقداماتی که باعث خشنودی دشمنان» شود، تاکید کرده بود.

مخالفان: دومینوی تبعیض حقوق‌ها در نهایت به فروپاشی نظام مالی دولت منتهی می‌شود

غلامحسین رضوانی نماینده مردم تهران در مجلس شورای اسلامی هم در همین رابطه با بیان اینکه دولت در لایحه بودجه ۱۴۰۱ متوسط افزایش حقوق کارکنان را ۱۰ درصد در نظر گرفته است، گفت: با توجه به اینکه این مقدار افزایش حقوق پاسخگوی تورم نیست، همه ما برای منافع کشور باید یک تا دو سال مشکلات را تحمل کنیم تا تورم کاهش یابد. نباید به صورت جزیره‌ای به قسمتی از دستگاه‌ها توجه کنیم. از طرفی یکی از راه‌های دریافت حقوق‌های نجومی همین تنوع در پرداخت حقوق هاست.

مهدی طغیانی نیز در مخالفت با کلیات طرح مذکور، گفت: اغلب کارکنان دولت با مشکلات معیشتی مواجه هستند. تورم شدیدی که در چند سال اخیر با آن مواجه بودیم، قدرت خرید همه کارکنان را کاهش داده و این مشکل تنها مختص قشر خاصی از کارمندان نیست. از طرفی افرادی که کارمند نیستند هم با این معضل مواجهند، لذا نباید افزایش حقوق را تنها برای کارکنان دولت و آن هم قشر خاصی از کارکنان در نظر گرفت.

نماینده مردم اصفهان در مجلس شورای اسلامی اظهار داشت: نگاه جزیره‌ای غلط و تبعیض‌آمیز است و ما باید در پیشگاه خداوند و مردم پاسخگو باشیم. دومینوی تبعیض حقوق‌ها در نهایت به فروپاشی نظام مالی دولت منتهی می‌شود.

موافقان: معدل حقوق کارکنان دادگستری‌ها زیر ۵ میلیون تومان است

همچنین علی بابایی کارنامی در موافقت با این طرح، گفت: کمیسیون اجتماعی به دلیل اهمیت موضوع با مرکز پژوهش‌ها و سازمان اداری استخدامی جلسات متعددی را طی یک سال گذشته برگزار کرد تا بتواند تصمیمی درست اتخاذ کند.

وی بیان کرد: ما با بررسی حقوق افراد شاغل در قوه قضائیه، وزارت دادگستری و کارکنان دادگستری به این نتیجه رسیدیم که معدل حقوق این کارکنان به زیر ۵ میلیون تومان می‌رسد و نیاز است به این وضعیت رسیدگی شود. این طرح قرار است طی ۳ سال انجام شود و بار مالی ایجاد نخواهد کرد. باید به کارکنان قوه قضائیه رسیدگی جدی کرد و با تصویب این طرح می‌توان به آن‌ها کمک کرد.

عضو کمیسیون برنامه و بودجه: به دنبال احیای طرح هستیم

در همین رابطه محمدرضا دشتی اردکانی در گفتگو با خبرنگار مهر در خصوص اعتراضات کارمندان قوه قضائیه به مخالفت با این طرح و امکان احیا و طرح مجدد آن گفت: در ماده ۱۳۰ آئین نامه داخلی مجلس آمده است؛ اگر طرحی مورد تصویب مجلس یا کمیسیون‌های موضوع اصل هشتاد و پنجم (۸۵) قانون اساسی واقع نشد بدون تغییر اساسی تا شش ماه دیگر نمی‌توان آن را مجدداً به مجلس پیشنهاد نمود مگر اینکه با تقاضای کتبی پنجاه نفر نماینده و تصویب مجلس مطرح باشد که در همین رابطه در تلاش هستیم فردا با کارشناسی بیشتر طرح و با ۵۰ امضا دوباره طرح را مطرح کنیم.

وی در پاسخ به این سوال که آیا تکثر در پرداخت حقوق‌ها منجر به ایجاد فساد می‌شود؟ گفت: اعتقاد کمیسیون بر این است که حقوق همه کارمندان را به طور یک مجموعه ببینیم و باید با هم دیده شود چرا که در این صورت است که عدالت نسبی هم ایجاد می‌شود.

با توجه به اینکه دادگستری‌ها و نهادهای وابسته به قوه قضائیه با حجم کار بسیار زیادی مواجه هستند و تشکیل ۱۵ میلیون پرونده توان مضاعفی از قضات و کارمندان می‌طلبد، بسیاری از قضات پرونده‌ها را به خانه برده و در وقت استراحت هم بر روی آنها کار می‌کنند.

عضو کمیسیون برنامه و بودجه مجلس شورای اسلامی ادامه داد: با توجه به اینکه دادگستری‌ها و نهادهای وابسته به قوه قضائیه با حجم کار بسیار زیادی مواجه هستند و تشکیل ۱۵ میلیون پرونده توان مضاعفی از قضات و کارمندان می‌طلبد، بسیاری از قضات پرونده‌ها را به خانه برده و در وقت استراحت هم بر روی آنها کار می‌کنند. بسیاری از کارمندان قوه قضائیه هم به جای ۳ الی ۴ کارمند کار می‌کنند بدون اینکه اضافه کار مناسبی داشته باشند.

دشتی اردکانی افزود: بسیاری از قضات و کارمندان دستگاه قضا در روزهای تعطیل خود به دنبال شغل دوم رفتند که این مسئله راندمان کار را کاهش می‌دهد.

وی با بیان اینکه البته دولت هم محدودیت‌ها و مشکلات خود را دارد، گفت: از مشکلات و محدودیت‌های دولت بی خبر نیستیم و معتقدیم در رابطه با این مسئله باید تدابیر دیگری اندیشیده شود.

اگر چه این طرح روز چهارشنبه با ۹۷ رأی موافق، ۱۱۵ رأی مخالف، ۱۳ رأی ممتنع از مجموع ۲۳۱ رأی با مخالفت نمایندگان مواجه شد، اما قوه قضائیه به عنوان ملجا و پناهگاه مردم و کسانی که از انواع تخلفات و جرم‌ها آسیب دیده‌اند باید التیامی بر زخم‌ها باشد.

البته مسئولان قوه قضائیه همواره بر موضوع کفاف و تطمیع شدن قضات و کارمندان تاکید کردند چرا که این موضوع یکی از راه‌های مقابله با فساد و به خطا رفتن بدنه انسانی دستگاه قضا است.

در پی تجمع های امروز پرسنل قوه قضاییه، حجت الاسلام محمد مصدق، معاون اول قوه قضاییه پیام تصویری را به پرسنل قوه قضاییه صادر کرد.

معاون اول قوه قضائیه ضمن ابراز تاسف از تصویب نشدن طرح فوق العاده خاص کارکنان قوه قضائیه از تلاش رئیس دستگاه قضا و موافقت دولت برای جبران مشکلات معیشتی کارکنان در سال جاری خبر داد.

حجت‌الاسلام والمسلمین مصدق ضمن تشکر از تلاس های شبانه روزی و بی وقفه کارکنان دستگاه قضا گفت: همکاران قوه قضائیه از پر تلاش ترین و محروم ترین قشر جامعه در مجموعه کارکنان دولت هستند.

معاون اول دستگاه قضا تاکید کرد: توجه به معیشت کارکنان همواره مورد توجه مسئولین دستگاه قضایی بوده و حجت‌الاسلام و المسلمین محسنی اژه ای، از نخستین روز مسئولیت خود، همواره بر این موضوع تاکید کرده است.

وی با اشاره به ابراز ناراحتی رئیس قوه قضائیه از عدم تصویب طرح طرح فوق العاده خاص کارکنان دستگاه قضا در مجلس شورای اسلامی، از پیگیری رئیس عدلیه برای جبران این موضوع خبر داد و گفت: در روزهای اخیر با پیگیری‌های رئیس قوه قضائیه، هماهنگی‌هایی در این زمینه با دولت انجام شد. به ویژه رئيس جمهور قول مساعد دادند که این موضوع به نحوی جبران شود.
