بحرینی: فقط سپردهگذاران مقصرند؟
رئیس کمیته پول، بانک و بازار سرمایه کمیسیون اقتصادی مجلس، توضیحاتی درباره مسائل پیش آمده در موسسات مالی و اعتباری ارائه کرد.
محمدحسین حسین زاده بحرینی نماینده مشهد و کلات در مجلس شورای اسلامی در یادداشتی با عنوان اینکه آیا فقط سپرده گذاران مقصرند، به بیان ملاحظاتی پیرامون مصاحبه اخیر معاون قوه قضائیه پرداخته است، که متن این یادداشت به شرح زیر است:
آن طور که در خبرها آمده است، معاون محترم امور اجتماعی و پیشگیری قوه قضائیه، در اظهارات اخیرشان در خصوص مؤسسات غیرمجاز نکاتی را مطرح کردهاند، که از جهاتی حائز اهمیت است. لازم است به اختصار چند مطلب را پیرامون این مصاحبه یادآور شویم:
۱- به نقل از خبرگزاریها، «معاون امور اجتماعی و پیشگیری قوه قضائیه گفته است: قانون گذار به صورت جدی در مقررات مختلف برای جلوگیری از برپایی موسساتی که مجوز ندارند، اقدام کرده است و برای سازمانها و دستگاهها و وزارت خانههای دولتی تکلیف ایجاد کرده است…. ولی در این ارتباط بانک مرکزی که مکلف به این جلوگیری بود، به وظیفه خود بخوبی عمل نکرد و امروز باید پاسخگوی تعلل و اهمال در انجام وظایف خود باشد. این مقام قضایی با بیان این که قوه قضاییه در این ارتباط تکلیف مستقیم نداشته است، تاکید کرد: قوه قضاییه با اعلام جرمی از طرف نهادهای مربوطه وارد رسیدگی میشود و با مجرمین برخورد میکند. موضوع فعالیت این موسسات به هیچ عنوان با قوه قضاییه ارتباط پیدا نمیکند. الفت تشریح کرد: بانک مرکزی و سایر دستگاههای این حوزه تلاش میکنند برای اهمال کاری خود شریک سازی کنند و به تعبیر رسانه ای توپ را در زمین قوه قضاییه بیاندازند. امروز شاهد هستیم مسئولان بانک مرکزی برای کم کردن بار مسئولیت خودشان در کلیه مصاحبهها بیجهت اسم قوه قضاییه را میآورند و مردم را متوجه دستگاه قضایی میکنند.»
این بخش از سخنان معاون محترم قوه قضائیه اگرچه منطبق با قانون مصوب سال ۱۳۸۳ مجلس شورای اسلامی است و در قانون مزبور، قوه قضائیه مستقیماً و «به صورت خاص» وظیفه ای در قبال مؤسسات اعتباری غیر مجاز ندارد، اما به هیچ وجه، نافی وظائف ذاتی این قوه که در قانون اساسی جمهوری اسلامی ایران بدان تصریح شده است، نمیباشد. از سال ۱۳۸۳ به این سو که به اعتراف معاون محترم قوه قضائیه، «قانون گذار بصورت جدی در مقررات مختلف برای جلوگیری از برپایی موسساتی که مجوز ندارند، اقدام کرده است و برای سازمانها و دستگاهها و وزارتخانههای دولتی تکلیف ایجاد کرده»، قوه قضائیه به استناد بندهای سوم، چهارم و پنجم اصل یکصد و پنجاه و ششم قانون اساسی وظائفی داشته که آنها را به درستی انجام نداده است. بند سوم اصل مزبور، «نظارت بر حسن اجرای قوانین» را جزء وظائف قوه قضائیه برشمرده است. آیا قوه محترم قضائیه وظیفه نظارت بر حسن اجرای «قانون تنظیم بازار غیرمتشکل پولی مصوب ۱۳۸۳» را به درستی انجام داده است؟ همچنین، بندهای چهارم و پنجم اصل یکصد و پنجاه و ششم، «کشف جرم» و «اقدام مناسب برای پیشگیری از وقوع جرم» را از وظائف قوه قضائیه برشمرده است. آیا قوه محترم قضائیه در ده سال گذشته، در قبال رفتار مؤسسات غیرمجاز که موجب «اخلال در اقتصاد کشور» شده و صدها هزار خانواده ایرانی را با مشکل روبرو کردهاند، متناسب با ظرفیت و وظیفه قانونی خود عمل کرده است؟ به هرحال، این جمله معاون محترم قوه قضائیه که «موضوع فعالیت این موسسات به هیچ عنوان با قوه قضاییه ارتباط پیدا نمیکند» مقرون به صواب و پذیرفتنی نیست. در این که بانک مرکزی، به عنوان مخاطب اصلی قانون تنظیم بازار غیر متشکل پولی، در رخداد این پدیده شوم در اقتصاد ایران مقصر است، تردیدی نیست؛ اما خلاف انصاف است که قوه قضائیه و مجلس شورای اسلامی، به عنوان دو نهادی که نظارت بر دستگاههای اجرائی، از جمله بانک مرکزی، و حسن اجرای قوانین جزء وظائف ذاتی آنها بوده، و کوتاهی آنها در انجام وظائف نظارتی شان، به بزرگ تر شدن ابعاد ماجرا انجامیده است، خود را از صحنه پاسخگوئی به مردم کنار بکشند و بانک مرکزی را در این مخمصه تنها بگذارند.
۲- معاون محترم قوه قضاییه در بخش دیگری از سخنان خود گفتهاند: «افرادی که پول خود را در این موسسات به ودیعه گذاشتند افراد عامی و بیاطلاع نبودند و اتفاقا برای بدست آوردن سودهای باد آورده با مطالعه و شناخت به سمت این مراکز رفتند و غالبا اطلاع داشتند که این مراکز بدون مجوز فعالیت میکنند. وی تاکید کرد: این افراد برای تحصیل منفعت بیشتر به این موسسات مراجعه کردند در واقع خودشان مقدم شدند به ضرری که امروز متوجه خودشان شده است. نباید آدمهایی که با شناخت قصد تحصیل سود داشتند مظلوم جلوه بدهیم و با مظلوم نمایی فضای جامعه را به گونهای ترسیم کنیم که باید دولت وارد شود و مبالغی را به اینها بپردازد. وی اظهار کرد: اینها سودجویی کردند و باید امروز ضرر سود جویی خود را بدهند.»
در رابطه با این عبارت معاون محترم قوه قضائیه نکاتی قابل توجه و تذکر است:
اولاً- از سال ۱۳۸۶ که آیین نامههای قانون تنظیم بازار غیرمتشکل پولی بعد از سه سال از تاریخ تصویب قانون، توسط دولت تصویب شد و بخصوص در سالهای ۱۳۸۹ به بعد، قریب به اتفاق مؤسساتی که در دو سه سال اخیر به عنوان مؤسسه غیرمجاز معرفی و سپرده گذاران آنها تنبیه شدهاند، در سایت رسمی بانک مرکزی و در تابلوهای آن مؤسسات، به عنوان «مؤسسات تحت نظارت بانک مرکزی» به مردم معرفی شده بودند. شایسته نیست یک مقام قضائی که علی القاعده باید مروج امنیت اقتصادی در کشور باشد، شهروندانی را که به مراجع رسمی همچون بانک مرکزی و تبلیغات انبوه صدا و سیمای جمهوری اسلامی ایران اعتماد کردهاند، «سودجو» بخواند و آنان را به خاطر سپرده گذاری در مؤسسات یادشده، تخطئه کند. بدیهی است این بیان به هیچ وجه شامل مؤسساتی که هیچ گونه سابقه تأیید از سوی بانک مرکزی ندارند و به معنی واقعی کلمه «غیرمجاز» هستند، نمیشود و اگر منظور معاون محترم قوه قضائیه صرفاً سپرده گذاران در اینگونه مؤسسات باشد، که البته تعداد آنها به شدتاندک است، حق با ایشان خواهد بود.
ثانیاً- این جمله معاون محترم قوه قضائیه که گفتهاند «افرادی که پول خود را در این موسسات به ودیعه گذاشتند افراد عامی و بیاطلاع نبودند و اتفاقا برای بدست آوردن سودهای باد آورده با مطالعه و شناخت به سمت این مراکز رفتند» قطعاً با عموم و اطلاقی که در بیان ایشان هست، صحیح نمیباشد. البته احتمال چنین رفتار سودجویانه ای توسط سپرده گذاران کلان منتفی نیست ولی واقعاً در مورد سپرده گذاران کوچک و متوسط نمیتوان و نباید اینگونه بیپروا سخن گفت و همه را از دم تخطئه کرد و سودجو نامید. این وظیفه قوه قضائیه است که به جای صدور حکم واحد برای میلیونها سپرده گذار کوچک و بزرگ، پرونده سپردههای کلان را که تعداد آنها نسبت به سپردههای کوچک و متوسط بسیارکمتر، و حجم ریالی آنها بسیار بیشتر است به صورت موردی مورد رسیدگی قرار دهد و متناسب با تقصیر احتمالی آنان، برایشان حکم صادر نماید.
در مجموع، آنچه در یکی دو سال اخیر در اقتصاد ایران اتفاق افتاده است، نماد خوبی از مدیریت بازار پول و دستگاه قضائی کشور نیست. در رخداد پدیده مؤسسات غیرمجاز علاوه بر متولیان مؤسسات مزبور و برخی از سپرده گذاران، بانک مرکزی، مجلس شورای اسلامی، قوه قضائیه و رسانهها، هریک به نحوی مقصر بودهاند. در عین حال، نحوه مواجهه بانک مرکزی با این موضوع، که متأسفانه مورد پشتیبانی قوه قضائیه هم هست، به گونه ای است که گویی در این ماجرا تنها یک مقصر وجود دارد و آن هم سپرده گذار است و بر همین اساس، همه سپرده گذاران، بدون توجه بهاندازه سپرده و احراز تقصیر یا عدم تقصیر آنان، مورد تنبیه قرار گرفتهاند. آیا معاون محترم قوه قضائیه در قبال این رفتار غیرمسؤولانه و حمایت قوه قضائیه از آن، پاسخ موجهی دارند؟
