یک حقوقدان و استاد دانشگاه نسبت به اظهارات امام جمعه مشهد واکنش نشان داد:
پاسخ به ابراز مخالفت آیت الله علم الهدی با اصلاح «گردشگری» و «شهروندی» در مشهد
هفته گذشته آیت الله علم الهدی نماینده ولی فقیه و امام جمعه مشهد در دیدار با معاون هماهنگی و مدیریت امور زائران استانداری خراسان رضوی و مدیرکل میراثفرهنگی، گردشگری و صنایع دستی خراسان رضوی و جمعی از مدیران تاسیسات و تشکلهای گردشگری استان اظهاراتی را درباره گردشگری مطرح کرد که واکنش هایی را به همراه داشته است.
به گزارش صبح امروز به نقل از سایت Alamolhoda.com، آیتالله علمالهدی با اشاره به اینکه در مسئله گردشگری استان متاسفانه در ادوار قبلی بسیاری از طرحها عملیاتی نشد، اضافه کرد: «بنده در مشهد با دو اصطلاح مخالف هستم، یک اصطلاح «گردشگری» و دیگری «شهروندی»؛ این شهر مال امام رضا (علیهالسلام) است و اولین شهروند این شهر نیز امام رضا (علیهالسلام) بودند که ایشان «زائر» و «مجاور» دارند.»
آیتالله علمالهدی با تأکید بر اینکه اسمها بار معنوی و اقتصادی دارند، افزود: مهم است که از چه نامهایی در شهر امام رضا (علیهالسلام) استفاده میشود زیرا امام هشتم (علیهالسلام) قطب فرهنگی جهان است، آنانی که در این شهر زندگی می کنند، شهروند نیستند بلکه «مجاور» امام رضا (علیهالسلام) هستند.
آیت الله علمالهدی یادآور شد: وقتی شما عنوان گردشگری را به شهر می،دهید، بسیاری از سرمایهگذارانی که دینداری برایشان مهم نیست، برای سرمایهگذاری به این شهر میآیند زیرا این شهر بهخاطر رفت و آمد ۴ میلیون زائر خارجی، شرایط اقتصادی بسیار مطلوبی دارند.
عضو مجلس خبرگان رهبری متذکر شد: شما خادمِ زائر امام رضا (علیهالسلام) هستید و باید با افرادی که سعی میکنند در شهر امام رضا (علیهالسلام) ناهنجاری ایجاد کنند، مقابله کنید؛ در بحث میراث فرهنگی نیز باید عرض کنم که بالاترین میراث این شهر، امام رضا (علیهالسلام) هستند پس باید مراقب معرفی این آستان و دیگر میراث فرهنگی باشید.
این اظهارات موجی را در رسانه ها به راه انداخت و ابراز مخالفت آیت الله علم الهدی با دو اصطلاح گردشگری و شهروندی باعث شد تا دکتر عباس شیخ الاسلامی حقوقدان و استاد دانشگاه نسبت یه این موضوع واکنش نشان داده و مطلب زیر را منتشر کرده است.
چند نکته در خصوص سخنان امام جمعه محترم مشهد
هر چند شک ندارم ایشان دغدغه دینی در حفظ دین مردم و نیز بافت سنتی و زیارتی مشهد را دارند؛ اما من به عنوان یک شهروند با این ادبیات (اگر واقعا منتسب به ایشان باشد) به چند دلیل حقوقی و غیر آن مشکل دارم و چند نکته که به ذهن من رسید؛ خدمتشان به عنوان یک معلم حقوق و وکیل دادگستری؛ عرض می کنم؛ امیدوارم مفید فایده باشد:
۱) آیه اصلی قرآن در باب حقوق شهروندی؛ آیه «لقد کرمنا بنی ادم »است، نه لقد کرمنا مسلمان؛ مومن؛ زائر و مجاور؛ بنابراین همه انسانها و شهروندان جدای از رنگ پوستشان یا دینشان کرامت دارند و به قول شیخ ابوالحسن خرقانی هر که به این سرا درآید، نانش دهید و از دینش نپرسید.
۲) دو مفهوم شهروند و گردشگر از نظر عرفی و قانونی دو واژه شناخته شده است و بارها در قوانین بینالمللی و داخلی تکرار شده است، در مقابل واژگان زائر و مجاور، هر چند در مشهد پایگاه عرفی و دینی دارد و لغات خوبی است، ولی واژگان دارای بار حقوقی نیست و نمی تواند جایگزین مناسب آن باشد.
۳) در هیچ قانونی اجازه تفاوت عبارات و واژگان حقوقی در یک شهر نسبت به شهر دیگر به خصوص اگر بار حقوقی هم داشته باشد داده نشده است، ما نمیتوانیم در مشهد صرفا به عنوان یک شهر خاص واژگانی که دارای بار حقوقی هستند را تغییر دهیم. این کار و آثار آن مصداق تبعیض ناروا بوده و مخالف بند نه و چهارده اصل سه و نیز اصل بیست قانون اساسی در تساوی حقوق مردم در کل کشور است.
۴) تقابل واژگان عرفی «شهروند و گردشگر »در مقابل واژگان دینی «زائر و مجاور »خلاف مصلحت و قاعده عقلی و فقهی «الجمع مهما امکن اولی من الطرح » است.
۵) این نوع ادبیات باعث می شود شهروندان مشهدی احساس کنند وجود معنوی بارگاه امام رضا (ع) مانع پیشرفت مادی شهر مشهد و آثار آن از جمله کارآفرینی و اشتغال است و تمام سرمایه گذاریها در این شهر باید در جهت ترویج مفهوم زائر و مجاور باشد، اصولا در این شرایط اقتصادی بد، در تقابل شرع و عرف و اقتصاد مردم ، این دین است که تضعیف میشود.
۶) برای من قابل درک نیست، چه اشکالی دارد که سرمایهگذاری که به فرض دین هم ندارد، بخواهد در حوزه گردشگری نه زیارت در مشهد، سرمایهگذاری مشروع کند و توریسم خارجی را به جای کشورهای غربی و همسایه به مشهد سوق دهد و رونق اقتصادی برای مشهد ایجاد کند، آیا این ادبیات مانع توسعه اقتصادی این شهر و گسیل شدن سرمایه ها به کشورها و شهرهای دیگر نمیشود.
۷) استاد علمالهدی عزیز، مردم و زائرین و گردشگران از قدیم اکثرا به عشق امام رضا (ع) به مشهد میآدند و میآیند و این شهر سرمایه ای جز امام رئوف ندارد، زیارتشان را که میکردند، به آرامگاه نادر، توس، کوهسنگی، وکیل آباد و طرقبه شاندیز و … دهم سری میزدند و آنهایی که پولدارتر بودند، سپس به شمال هم میرفتند و اینها مقابل هم نبود.
حال هم بگذاریم خودشان تصمیم بگیرند، امام رضا(ع) جای خودش را در قلب مردم حتی بی دینها هم دارد، فقط مهم آن است ما قبول کنیم بهجای اینکه امام رضا را نجات دهیم، اقتصاد مردم را نجات دهیم تا بتوانند به زیارت و سیاحتشان برسند.
