عضو ناظر مجلس شورای اسلامی در کارگروه تعیین مصادیق محتوای مجرمانه رایانه‌ای با تاکید بر اینکه درباره استمرار محدودیت‌های اعمالی در دسترسی به اینستاگرام و واتس‌اپ فعلاً تصمیم‌گیری نشده است، گفت: از نظر من چنانچه اینستاگرام و واتس‌اپ قرارداد و تفاهم نامه‌ای امضا کنند و شروط جمهوری اسلامی ایران را بپذیرند و متعهد به پذیرش مسئولیت شوند، منعی برای فعالیت آنها وجود نخواهد داشت.
مهدی باقری در گفت‌وگو با ایسنا با بیان اینکه «اعمال محدودیت در دسترسی به اینترنت و همچنین برخی پیام‌رسان‌ها و نرم افزارها با تصمیم کارگروه تعیین مصادیق محتوای مجرمانه رایانه‌ای نبوده است» اظهار کرد: به لحاظ قانونی هر نهاد و کمیته‌ای مسئولیت خاص خودش را دارد؛ کارکرد کمیته تعیین مصادیق محتوای مجرمانه رایانه‌ای ناظر به مسائل دائمی و در راستای سلسله روندها و روال‌های مربوط به قانون گذاری در تشخیص و تعیین مصادیق است.
وی افزود: شورای امنیت ملی و شورای امنیت کشور نسبت به مسائل جاری و اجرایی تصمیم‌گیری می‌کنند و تصمیمات آنها از جنس قانون‌گذاری‌های دائمی و تعیین مصداق نیست؛ این شوراها در مواردی نظیر آنچه این روزها اتفاق افتاده، تصمیم‌گیری می‌کنند و تصمیمات آنها نیز فوق تصمیمات مجلس است.

درباره استمرار محدودیت‌های اعمالی در دسترسی به اینستاگرام و واتس‌اپ فعلاً تصمیم‌گیری نشده است
این عضو کارگروه تعیین مصادیق محتوای مجرمانه رایانه‌ای در پاسخ به این پرسش که آیا قرار است محدوتیت‌های اعمالی در دسترسی به نرم‌افزارهای اینستاگرام و واتس‌اپ همچنان ادامه داشته باشد؟ تاکید کرد: من از اینکه کسی گفته باشد که بعد از بازگشتن به شرایط عادی قصدی برای جلوگیری از فعالیت این نرم افزارها وجود دارد یا اینکه کسی ادعا کرده باشد که همچنان اجازه فعالیت به این نرم افزارها داده خواهد شد، بی اطلاع هستم؛ در این مورد فعلاً تصمیم‌گیری نشده است و از هیچ نهاد، کمیسیون، کمیته و فردی نشسنیده‌ام که در این زمینه تصمیمی گرفته باشند.
باقری در ادامه با تاکید بر اینکه در تصمیمات ملی تمام جوانب باید لحاظ شود، گفت: نه از طرفی راضی هستیم که به کسب و کار کسی لطمه‌ای وارد شود و نه از طرفی راضی هستیم که به بهانه کسب و کار، اغتشاش‌گران از فرصت اینترنت استفاده کنند و به جان و مال مردم و بیت‌المال لطمه بزنند؛ قطعاً کسی حتی کسب و کارش درگیر فضا مجازی است نیز راضی نیست که بدون هیچ جرمی و بخاطر تحریک اوباش، عزیران و اعضای خانواده‌اش کشته شود.
اغتشاش‌گران و اوباش از فضای مجازی برای شبکه‌سازی استفاده کردند
وی با بیان اینکه «تعدادی اوباش از جایی دستور گرفتند تا کشته سازی داشته باشند»، اضافه کرد: همه فرصتی که برای شبکه‌سازی این اغتشاش‌گران و اوباش فراهم شده، از فضای مجازی بوده است. متاسفانه افرادی که الان در مناطق مختلف کشور مورد تعدی قرار گرفتند و بعضاً جان‌شان را از دست دادند از نوجوانانی هستند که به هیچ عنوان در فضای مربوط به این اغتشاشات نبودند.

بازگشت شرایط به حالت عادی و استفاده مردم از تمامی ظرفیت‌ها از جمله فضای مجازی موضع همه مسئولان است
این عضو کمیسیون حقوقی و قضایی مجلس اظهار کرد: بازگشت شرایط به حالت عادی و استفاده مردم از تمامی ظرفیت‌ها از جمله فضای مجازی به ویژه برای کسب و کارها موضع همه ماست اما از زمانی که شرایط کشور به گونه‌ای باشد که امنیت جان و مال مردم تامین شود. همه مسئولانی که در کشور پیگیر این داستان هستند خیلی علاقه مندند که سریعاً شرایط به حالت عادی بازگردد، منتها همانطورکه آقای وزیر کشور اظهار نظری داشتند، بازگشت شرایط به حالت عادی منوط به این است که دستگاه‌های امنیتی کشور گزارشی بدهند که به صورت کامل اغتشاش‌گران یا بازداشت شدند یا اینکه از کشور متواری شده‌اند.
باقری تاکید کرد: به عنوان یک نماینده مجلس و با رویکرد حقوق می‌گویم که تلگرام، اینستاگرام و واتس‌اپ هیچکدام موضوعیت ندارند بلکه آنچه که موضوعیت دارد قانون‌مداری و تامین منافع مردم است. با فعالیت تلگرام به شرط پذیرش قوانین جمهوری اسلامی مشکلی نداشتیم؛ چه بسا اینکه در شروع فعالیت این پیام‌رسان در ایران نیز همین گونه بود و تلگرام در ابتدای فعالیت خود در کشور با این رویکرد که قوانین را رعایت می‌کند شروع به کار کرد اما در ادامه با رعایت نکردن قوانین جلوی کارش گرفته شد.
وی خاطر نشان کرد: نه فقط پیام‌رسان‌ها یا نرم افزارهای خارجی مانند اینستاگرام بلکه حتی پیام‌رسان‌های داخلی نیز هر زمان که بخواهند کمکی به اغتشاش‌گران کنند و با آنها همراهی داشته باشند، قطعاً با واکنش‌هایی مواجه خواهند شد.
این عضو کارگروه تعیین مصادیق محتوای مجرمانه رایانه‌ای گفت: در خصوص اینستاگرام و واتس‌اپ تمامی مسائل وابسته به این است که آیا با ایران همکاری می‌کنند یا نه؛ نمی‌شود که به پیام‌رسانی مثل واتس‌اپ اجازه فعالیت داده شود اما قصد این پیام‌رسان ابزارسازی و بسترسازی برای آشوب‌ها باشد؛ ما خدمت به مردم را یک طرف مساله می‌دانیم و از طرف دیگر نمی‌خواهیم که ابزار دست دشمن را با دست خودمان فراهم کنیم. آنچه که مهم است این است که چنانچه اینستاگرام و واتس‌اپ یا هر نرم افزار دیگری به قوانین جمهوری اسلامی پایبند باشند، قطعاً هیچ مشکلی برای فعالیت در ایران نخواهد بود.

وی با بیان اینکه «بارها از اینستاگرام و واتس‌اپ خواستنه شده که با ایران همکاری کنند، اما نپذیرفتند»، اظهار کرد: اگر همکاری می‌کردند قطعاً این فرصت اغتشاشات مهیا نمی‌شد. همانطور که چنانچه امروز اینستاگرام بخواهد در کشورهای اروپایی فعالیت کند و به اغتشاشگران و آشوبگران آموزش بدهد نقض قانون است در ایران نیز واتس‌اپ و اینستاگرام می‌توانستند در تامین امنیت ایران کمک کنند اما به هیچ عنوان همکاری نکردند و کاملا فضا را برای آموزش آدم کشی و درست کردن مواد منفجره و هر آنچه که می‌توانست موجب اغتشاشات شود، باز گذاشتند.
این نماینده مجلس تاکید کرد: جان و مال مردم اولین موضوعی است که ما نمایندگان مجلس پیگیر آن هستیم و برای ما نیز مهم نیست که بستر فراهم شده برای سلب امنیت مردم از طریق نرم‌افزار و پیام‌رسان خارجی فراهم شده باشد یا داخلی؛ در شرایط عادی ما دنبال هر نرم افزار و مجموعه‌ای که به مردم خدمات بهتری ارائه دهد، خواهیم بود؛ اینستاگرام و واتس‌اپ قبلاً در شرایط پیش از آشوب‌ها شرایط کسب و کار را فراهم کرده بودند به همین دلیل نیز برای‌شان فضا فراهم شده بود و داشتند فعالیت می‌کردند منتها وقتی فضایی علیه جان و مال مردم فراهم کردند، با محدودیت‌هایی در دسترسی مواجه شدند؛ با این وجود به یاد ندارم که تا به حال هیچ کدام از مسئولان دولتی، نمایندگان مجلس و شورای امنیت ملی برای جلوگیری از فعالیت این نرم افزارها تصمیمی گرفته باشند.
منعی برای ادامه فعالیت اینستاگرام و واتس‌اپ به صورت مشروط وجود ندارد
باقری در پایان با بیان اینکه «بعد از بازگشت شرایط به حالت عادی گذشته به صورت مشروط، برای ادامه فعالیت اینستاگرام و واتس‌اپ منعی وجود ندارد»، گفت: از نظر من چنانچه اینستاگرام و واتس‌اپ قرارداد و تفاهم نامه‌ای امضا کنند و شروط جمهوری اسلامی ایران را بپذیرند و متعهد به پذیرش مسئولیت شوند، منعی برای فعالیت آنها وجود نخواهد داشت.
