نا‌کارآمدی مدیران اجرایی عامل خسارت‌های مالی

ترک فعل در اصطلاح حقوق جزا عبارت است از امتناع از ایفای تکلیفی که موضوع حکم قانون‌گذار بوده است. در برخی موارد قانون‌گذار امر به انجام کاری کرده است و خودداری از انجام آن باعث تحقق جرم می‌شود. لذا این جرایم از طریق ترک فعل واقع می‌شوند ، ترک فعل ناظر به خودداری از انجام فعلی است که شخص مکلف به آن بوده است.

در سال‌های اخیر، فهرست خسارت‌های ملی ناشی از «ترک فعل خسارت بار مدیران» افزایش یافته است! آتش سوزی عظیم ساختمان پلاسکو در اواخر سال ۱۳۹۵، سیل ویرانگر و خسارت‌بار اواخر سال ۱۳۹۷ و نیز ابتدای سال ۱۳۹۸، آتش سوزی مرکز پزشکی سینااطهر در سال ۱۳۹۹ و اخیرا نیز خودکشی ساجده، دختر ۱۵ ساله در یکی ازآسایشگاه‌های بهزیستی مشهد، برخی از مصادیق خسارت‌های زیانباری است که در سطح ملی و حتی بین‌المللی پدید آمده است و عامل اصلی آن «ترک فعل ناشی از بی توجهی» و عدم رعایت استاندارد‌های لازم توسط مقامات، اشخاص حقوقی و حقوق عمومی است.

قانون در خصوص ترک‌فعل چه می‌گوید؟

در بند ۱۴ ماده ۵۵ قانون شهرداری و تبصره‌های آن که در سال ۱۳۴۵ اصلاح شده است، شهرداری مکلف به رفع خطر و جلوگیری از اقداماتی شده است که اگر به آن توجه می‌کرد و آن وظیفه را ترک نمی‌کرد، حادثه پلاسکو و همچنین آتش سوزی بیمارستان سینااطهر پدید نمی‌آمد!

 

یکی از اقدامات دستگاه‌ قضایی مطابق با مقررات قانون اساسی، بحث پیش‌گیری از وقوع جرم و رسیدگی به شکایات کیفری است. دستورالعمل‌هایی در راستای پرونده‌های اقتصادی و هم‌چنین ترک فعل مدیران دولتی از ناحیه رهبری ابلاغ شد که می‌توان اولین آن را دستورالعمل نظارت و پیگیری حقوق عامه دانست که در سال 97 تصویب شد و خصوصا در سند تحول قضایی فعلی بسیار مورد توجه قرار گرفته است.

 

در اجرای بند‌های دوم و سوم اصل ۱۵۶ قانون اساسی جمهوری اسلامی ایران، سیاست‌های کلی نظام، قانون تشکیل سازمان بازرسی کل کشور با اصلاحات و الحاقات بعدی و وظیفه قانونی قوه قضاییه در حفظ حقوق عامه و نظارت بر حسن اجرای قوانین و با توجه به احکام مقرر در مواد ۹۰، ۹۱ و ۹۲ قانون مدیریت خدمات کشوری، مصوب ۱۳۸۶ که مدیران و سرپرستان بلافصل در دستگاه‌های اجرایی را مسئول نظارت، کنترل و حفظ روابط سالم کارمندان خود در انجام وظایف محوله و موظف به رعایت قانون و اجتناب از هرگونه رفتار ناقض قانون اعم از فعل یا ترک فعل می‌داند و با لحاظ این‌که ترک وظایف قانونی مدیران و اهمال و سهل‌انگاری در اجرای قانون و عدم اعلام جرایم و تخلفات ارتکابی در حوزه تحت تصدی، موجب مسئولیت قانونی آنان است.

جانشین معاون دادستان عمومی و انقلاب مرکز خراسان‌رضوی در این خصوص می‌گوید: در شرایط فعلی ما با یک جنگ اقتصادی روبرو هستیم که تمام توان و امکانات و فکر و ذهن ما باید در راستای مبارزه با این امر قرار بگیرد تا بتوانیم خود را برای یک مقابله جانانه با فساد اقتصادی که متاسفانه دامن‌گیر دستگاه‌های دولتی ما شده‌ آماده کنیم .

به گزارش «صبح امروز » صادق غرابادیان می‌افزاید: از ابتدای حضور آیت‌الله رئیسی در دستگاه قضایی و همچنین اواخر دوره آیت‌الله آملی لاریجانی، از طریق تشکیل دادگاه‌های ویژه اقتصادی به طور منظم و سازمان‌یافته مبارزه با این امر آغاز شد.

ترک فعل مدیران دایره قضایی

جانشین معاون دادستان عمومی و انقلاب مرکز خراسان‌رضوی در خصوص توجه به مساله ترک فعل مدیران در دایره قضایی اظهار می‌کند: یکی از اقدامات دستگاه‌ قضایی مطابق با مقررات قانون اساسی، بحث پیش‌گیری از وقوع جرم و رسیدگی به شکایات کیفری است. دستورالعمل‌هایی در راستای پرونده‌های اقتصادی و هم‌چنین ترک فعل مدیران دولتی از ناحیه رهبری ابلاغ شد که می‌توان اولین آن را دستورالعمل نظارت و پیگیری حقوق عامه دانست که در سال 97 تصویب شد و خصوصا در سند تحول قضایی فعلی بسیار مورد توجه قرار گرفته است.

وی ادامه می‌دهد: حقوق عامه در تمامی قوانین و مقررات ما ثابت است و نقض این حقوق، بخش عمده‌ای از جامعه را اعم از منطقه، محدوده و … در بر می‌گیرد و موجب سلب امتیاز منافع از این مردم می‌شود.

غرابادیان خاطرنشان می‌کند: دراین دستورالعمل، چهار نهاد در دستگاه قضایی به صورت خاص و ویژه مورد خطاب قرار گرفته‌اند تا بحث حفظ حقوق عامه و صیانت از حقوق جامعه را مدنظر قراردهند. این نهادها شامل سازمان بازرسی، دادستانی کل کشور، دادستان‌های مراکز استان و شهرستان‌ها و دیوان عدالت اداری که مرجع تظلم‌خواهی در برابر شکایت‌هایی است که نهادهای عمومی طرف دعوی قرار می‌گیرند؛ می‌باشند.

وی تشریح می‌کند: ما در سال ۹۹، دستورالعمل نحوه مقابله با ترک وظایف قانونی مدیران و کارمندان و پیشگیری از آن را داشتیم که از ناحیه ریاست قوه قضاییه ابلاغ شد. در این دستورالعمل ذکر شده‌ که ترک وظایف توسط مدیران و اهمال و سهل‌انگاری در اجرای قانون و عدم اعلام به‌موقع جرایم و تخلفات ارتکابی در حوزه تحت تصدی، موجب مسئولیت قانونی آن‌هاست و پشتوانه این صحبت قانون مدیریت خدمات کشوری می‌باشد.

جانشین معاون دادستان عمومی و انقلاب مرکز خراسان‌رضوی عنوان می‌کند: متاسفانه تلنگر و ابتدای این موضوع در سیل خوزستان و یا شیراز مشاهده شد که سهل‌انگاری‌ها و اهمال‌هایی موجب ضرر مالی فراوان نسبت به اموال و امکانات شهری و هم‌چنین اموال مردم شد این ترک فعل‌ها و اهمال‌ها هم حقوق بیت‌المال و هم حقوق افراد جامعه را نشانه و هدف گرفته ‌است.

غرابادیان ادامه می‌دهد: برای مثال در پرونده فساد مالی در اداره مالیات استان، مشاهده شد که به‌جهت ترک فعل مدیر مربوطه سازمان، این فرد به موجب قرار نظارت قضایی برداشته ‌شد و دلیل این موضوع، عدم اعلام تخلفات مالی بود که بعضی از زیردستان آنان انجام داده ‌بودند و ایشان علی‌رغم اطلاع از موضوع، آن را به مرجع قضایی منعکس نکرده‌ بود و اسناد این اتفاق کشف شد و ایشان به جهت اهمال و ترک وظیفه در اعلام تخلف و جرم، تحت تعقیب قرار گرفت.

لزوم رسیدگی دقیق و فوری به پرونده‌ها

غرابادیان در خصوص لزوم تسریع در رسیدگی به پرونده‌های قضایی اظهار می‌کند: در رسیدگی‌های قضایی، خصوصا در جرایم اقتصادی مدیران، اثر کار ما به رسیدگی فوری و دقیق ماست و اگر پرونده‌ای چندین سال در دستگاه قضایی مورد رسیدگی قرار بگیرد، اثر لازم را ندارد و در این دستورالعمل سازمان بازرسی مکلف شده‌ که به‌صورت فوق‌العاده تکلیف مدیران را مورد بررسی و گزارش قراردهد و پیگیر نتیجه گزارش ارسالی باشد.

وی در ادامه می‌گوید: اعلام به دستگاه‌های اجرایی در صورت عدم اقدام به‌موقع در طرح دعوی قضایی در موارد تضییع حقوق عامه است؛ یعنی گاهی اوقات مشاهده می‌شود که جرمی اتفاق نیافتاده‌است، اما یک روندی که در اداره طی می‌شود، به موجب قوانین و مقررات در نهایت باعث تضییع منافع عمومی می‌شود که سازمان بازرسی مکلف است نسبت به پیگیری و هشدار به سازمان جهت طرح دعوی اقدامات لازم را انجام دهد.

وظایف دادستانی‌ها در مقابله با ترک فعل

غربادیان در خصوص وظایف دادستانی‌ها در مقابله با ترک فعل مدیران اجرایی بیان می‌کند: دادستان‌ها نیز در راستای اجرای این دستورالعمل وظایفی دارند که بحث پیگیری حقوقی خسارت‌های وارده به حقوق عامه بدون پرداخت هزینه دادرسی درصورت عدم اقدام به‌موقع دستگاه اجرایی است. درصورتی که دستگاه اجرایی به جهاتی اقدام مقتضی را جهت بازگشت منافع عمومی و بیت‌المال انجام ندهد، دادستان مکلف به اجرای طرح دعوی است و در این‌جا از پرداخت هزینه دادرسی معاف شده ‌است.

تعقیب قضایی مدیران اهمال‌کار

وی تشریح می‌کند: موضوع دیگر بحث تعقیب قضایی مدیرانی‌ست که به جهت اهمال و ترک وظیفه خود، موجب نقض حقوق عامه شدند و اگر جرمی واقع شود، دستگاه قضایی به موجب گزارش اقدام مقتضی را انجام خواهد داد، وظایف دادستان بالغ بر پنج هزار وظیفه است که شامل همه موضوعات می‌شود و بخشی از آن ناظر بر موضوع حقوق عامه می‌باشد.

اهمیت رسیدگی قاطعانه، به ترک‌فعل

وی در خصوص اهمیت رسیدگی قاطعانه به ترک فعل در مدیران می‌گوید: ما در پرونده‌های قضایی به شدت بر روی این ماده حساس هستیم. اگر ما ببینیم مدیری از تخلف در حوزه مدیریت خود مطلع شده و اسناد آن موجود است، قطعا پیگیری کرده و مدیر را مجازات می‌کنیم و علت این است که اگر نظارت مدیر وجود داشت و اگر سهل‌انگاری مدیر نبود، چنین تخلفاتی در ادارات و سازمان‌های دولتی شاهد نبودیم.

طرح جدید رسیدگی به پرونده‌های قضایی

وی در ارتباط با طرح جدید رسیدگی به پرونده‌های قضایی بیان می‌کند: با توجه به این که در دوران تحول دستگاه قضایی قرارداریم، به جهت تغییر فرایند رسیدگی قضایی از حالت سنتی به حالت سیستماتیک طرح ساماندهی و تحول ارجاع شکواییه در دادسرا را اغاز کردیم. در این طرح زمانی که ارباب رجوع شکواییه خود را مکتوب می‌کند، هیچ هزینه‌ای پرداخت نمی‌کند و از طریق سیستم نوبت‌دهی نوبت دریافت کرده و در انتظار می‌نشیند. دادیاران ارجاع فراخوانی به این افراد می‌دهند و وارد مصاحبه حضوری با قاضی می‌شوند و در آن‌جا متوجه می‌شوند که شکایت این افراد چه نتیجه‌ای در بر دارد.

کاهش چشم‌گیر پرونده‌های قضایی در استان

صادق غربادیان در خصوص کاهش چشم‌گیر پرونده‌های وارده به دادسرای خراسان رضوی می‌گوید: ما در دادسرای مرکز استان، کاهش حداقل 50 درصدی پرونده‌های وارده را داریم که این  موضوع موفقیت بزرگی است و باعث می‌شود تا همکاران ما بتوانند در خصوص پرونده‌های ارجاع‌شده با فرصت کافی و بیش‌تر رسیدگی کند و رضایت مندی ارباب رجوع ها و وکلای دادگستری را داریم که این رضایت مندی‌ها سخت به دست می‌اید؛ چرا که افرادی که دادسراها می‌آید، غالبا اسیب‌دیده هستند و گلایه از وضعیت به‌وجود آمده دارند.  هم‌چنین ما قضات ارجاع را افزایش دادیم که پیش از این به این نحو نبود که این موفقیت بسیار بزرگی در حوزه تکریم ارباب رجوع است.
