در قانون چند قدم عقب هستیم
وکیل پایه یک دادگستری گفت: مجلس شورای اسلامی در قوانین بایستی به‌روز و نیز در فقه پویا پیشگام باشد که نیست و حرکت مجلس در حوزه زنان کند است.
به گزارش روزنامه”صبح امروز” عباس شیخ‌الاسلامی در نشست «راه دشوار زن بودن» که با موضوع بررسی عملکرد فراکسیون زنان مجلس شورای اسلامی و قوانین حمایتی از زنان در دانشکده روانشناسی و علوم تربیتی دانشگاه فردوسی مشهد در عصر روز چهارشنبه به مناسبت هفته منع خشونت علیه زنان برگزار شد، افزود: مباحث حقوقی در کشور ما مظلوم واقع شده و به‌خصوص مبانی حقوقی ما بسیار ضعیف است و ما در ابتدایی‌ترین موضوعات حقوقی که دنیا آن را حل کرده مانده و عقب هستیم.
تعارض فقه و آرای آنان
وی سخنان خود را با طرح چنین سوال‌هایی شروع کرد: در حوزه تعارض فقه و آرای فقیهان با موضوع مسائل حقوقی چه کرده‌ایم؟ تفاوت فقه و حقوق مدرن، تفاوت دموکراسی و دیکتاتوری، تفاوت دولت سنتی و مدرن چیست؟ این‌ها موضوعات مبنایی هستند که حل مشکلات ریشه‌ای ما در گرو پاسخ و حل به این چالش‌ها است.
شیخ‌الاسلامی اظهار داشت: ما از یک‌پارچگی در مسائل حقوقی بهره‌مند بوده چرا که حقوق دانشی است که چارچوب‌های مشخص داشته و مدرن و به‌روز بوده و می‌تواند به راحتی تغییراتی را در ان ایجاد کرد. در این حوزه باید تعارض فقه و حقوق مدرن را حل کرده و با تلاش در جهت فهم خواسته و نیاز جامعه که به اصطلاح زمان و مکان را در تشخیص موضوعات به‌کارگرفته تا مسائل حوزه زنان در این چارچوب حل شود.
ارثیه مهم‌ترین اجحاف در حق زنان
شیخ الاسلامی در توضیح برخی چالش‌های قانون‌گذاری در زمینه حقوق زنان مطرح کرد: ارث زنان یکی از موارد چالشی قانون بوده که برای حل این چالش باید اندیشه‌ای تدبیر شود به طور مثال تقسیم در زمان حیات و… انجام پدیرد که تلاش‌هایی در این زمینه شده است این‌که زن از ورثه ارث ببرد گام بزرگی است.
وی ادامه داد: چالش دیه را داریم که تاحدودی با بیمه حل شده و دیه را مساوی کرده است. حق طلاق زن با این‌که جایگاه فقهی دارد، اما اگر با فقه آن را حل نکنیم شاید حقوق مدرن بتواند موضوع را حل کند. حق قضاوت زنان مطمئناً در آینده نزدیک حل شده و زنان می‌توانند قاضی محکمه هم نیز باشند و تفسیر رجال سیاسی در قانون اساسی درمورد ریاست جمهوری باید حل شود. زنان هم می‌توانند رئیس جمهور شوند.
ایستادن دور از تعصبات
شیخ الاسلامی با اشاره به اخبار جدید مبنی بر منع کوه‌نوردی بانوان بدون اجازه همسر توضیح داد: اگر برخی مسائل را رها کنیم عده‌ای هستند که بسیار متعصب هستند و تفکرات در سنتی دارند که زن باید در محدوده خانواده بماند و تمکین شوهر را کند، اما تفکرات مدرن فقهی هم در حوزه خانواده وجود دارد که می‌شود با آن بسیاری مسائل را حل کرد.
در ادامه این نشست عضو فراکسیون مجلس شورای اسلامی گفت: این دوره از مجلس در حوزه زنان ویژگی‌های برجسته‌ای نسبت به ادوار گذشته داشته و در این دوره با حدود ۱۷ نماینده زن بیش‌ترین تعداد نمایندگان زن را داریم که البته هنوز درصد کمی از کل را تشکیل می‌دهد و حدود ۶ درصد است.
حضور موثر زنان در مجلس
حمیده زرآبادی افزود: نمایندگان زن حاضر در مجلس دهم در شوراهای تأثیرگذای هم‌چون شورای توسعه مدیریت و برنامه‌ریزی، شورای عالی سلامت و امنیت غذایی و نیز هیئت بورس عضویت داشته که در این شوراها تصمیمات مهمی در حوزه زنان اخذ می‌شود.
وی تصریح کرد: تعداد حضور زنان در این شوراها و هیئت‌ها نسبت به ادوار گذشته رشد داشته که علی‌رغم این‌که تعداد زنان تحصیل‌کرده در کشور ما از تعداد مردان بیش‌تر است، اما تعداد زنان در مناصب تصمیم‌گیری کم است و درنتیجه بانوان نمی‌توانند در قوانین تاثیرگذار باشند؛ به همین دلیل قوانین بعد زنانه پررنگی ندارند.
منع قانونی حضور در ورزشگاه‌ها
زرآبادی تاکید کرد: حضور زنان در ورزشگاه‌ها منع قانونی نداشته و در این حوزه ما از منظر قانونی نمی‌توانستیم به موضوع وارد شویم به همین دلیل از بعد نظارتی وارد شده تا این‌که این کار برای گروه‌هایی که شاید ورود آن‌ها به ورزشگاه راحت‌تر بود، انجام شد.
وی اظهار داشت: در موضوع زنان راه دشوار است و ما نیز معتقدیم که محدودیت‌‌ها یک‌جا برداشته شوند، اما به دلیل موانعی مجبور هستیم برخی مسائلی را تدریجی پیش ببریم تا به نتایج مطلوب برسیم.
وی اقدامات دولت در حوزه زنان را به این‌گونه تشریح کرد: کاهش ساعت کاری زنانی که فرزند زیر ۶ سال یا معلول دارند را به تصویب رسانده و نیز ممنوعیت ازدواج زیر ۱۳ سال برای دختران در مجلس تصویب شد و در حال حاضر در کمیسیون تخصصی در حال بررسی است.
رشیده بودن؛ شرط ازدواج بدون اذن پدر
زر ابادی در خصوص طرح ازدواج بدون اذن پدر گفت: طرحی که ارائه دادیم یک شرط داشت آن هم این بود که دختران بالای ۲۸ سال بتوانند بدون اذن پدر ازدواج کنند که متاسفانه این موضوع به صورت بدی در رسانه‌ها منتشر شد .
وی بیان کرد: فقه در مورد ازدواج دختر بدون اذن پدر می‌گوید دختر باید رشیده باشد و رشیده را تعریف می‌کند که فقط سن رشد نیست، زیرا سن رشد ۱۸ سالگی است و منظور از رشیده این است که جامعه دختر را از نظر استقلال و تأمین نیازهایش قبول داشته باشد.
زرآبادی تدکر داد: قانونی که درحال حاضر برای ازدواج دختر بدون اذن پدر داریم خودش، خودش را نقض می‌کند و اشکال ساختاری دارد. در قانون داریم اگر دختری بدون اذن پدر ازدواج کند. پدر می‌تواند شکایت کند و ازدواج باطل شود اما با عمل به این کار آن دختر که ازدواج کرده و دیگر شامل این قانون نشده و یعنی می‌تواند دوباره برود با همان فرد ازدواج کند.
این عضو فراکسیون زنان مجلس شورای اسلامی یادآور شد: قوانین ما باید چتری حمایت‌گر باشد برای خانواده‌ها و افرادی که آسیب دیده یا در معرض آسیب هستند چرا که در یک خانواده سالم که تمام تصمیمات چه برای دختر چه پسر به همراه خانواده گرفته شده و مشکلی به‌وجود نمی‌آید.
وی خاطر نشان کرد: برای دختری که پدرو مادرش از هم جدا شده و او با مادر زندگی می‌کند، اگر بخواهد ازدواج کند، پدر می‌تواند به دلیل لجبازی اجازه ازدواج ندهد و راه حل قانونی این است که دختر به دادگاه رفته و اجاره ازدواج گرفته و دادگاه نیز بر اساس رشیده بودن رأی صادر می‌کند. وقتی شروع ازدواج یک دختری که در خانواده آسیب‌دیده بوده از دادگاه باشد، می‌تواند مشکلات بیش‌تری به وجود آورد. ضمن این که وقتی فقه چنین اجازه‌ای داده بهتر است این موضوع در قوانین ما هم باشد.
