وزارت خارجه دعاوی حقوقی با آمریکا را مرتفع کند

نماینده تربت جام، تایباد و باخرز در مجلس شورای اسلامی گفت: وزارت خارجه باید از طریق دیوان یا مذاکرات یا با استفاده از شیوه حکمیت و داوری دعاوی حقوقی ایران و آمریکا را مرتفع سازد.

جلیل رحیمی جهان آبادی در خصوص نحوه پیگیری دعاوی حقوقی بین ایران-آمریکا  افزود: وزارت امور خارجه موظف به پیگیری این دعاوی است، معاونت حقوقی ریاست جمهوری تنها نقش مشورتی برای وزارت امور خارجه می‌تواند داشته باشد. زیرا وزارت خارجه تنها نهاد مسئولی است که می‌تواند در خارج از کشور طرح دعاوی کند.

نماینده مردم تربت جام، تایباد، باخرز در مجلس شورای اسلامی، تصریح کرد: قانون اساسی نیز مسئولیت دفاع از حقوق ملت در مجامع بین‌المللی را بر عهده وزارت خارجه نهاده است، لذا وزارت خارجه باید طرح دعوا کند و با بررسی، نحوه پیگیری از طریق دیوان یا حل مشکل از طریق حکمیت و داوری را مشخص کند.

وی افزود: علاوه بر دیوان، شیوه‌های داوری برای رفع اختلافات بین کشورها استفاده می‌شود کما اینکه برای بررسی دعوای بین ایران و آمریکا در موضوع حمله به سکوهای نفتی از شیوه داوری استفاده شده است. به این صورت که دو طرف دعوا تعدادی داوران را انتخاب و بر اساس رأی و حکمیت به رفع اختلاف پرداخته می‌شود.

رحیمی جهان آبادی تاکید کرد: معاونت حقوقی ریاست جمهوری خارج از کشور نمی‌تواند فعالیت حقوقی داشته باشد، کما اینکه وزارت خارجه به صورت قانونی موظف به پیگیری دعاوی حقوقی بین کشورها است. از سوی دیگر وزارت امور خارجه در مذاکرات رسمی با کشورهای دیگر نیز می‌تواند موضوع دعاوی حقوقی را پیگیری کند.

عضو هیات رئیسه کمیسیون قضایی و حقوقی مجلس شورای اسلامی، گفت: در حقیقت برای طرح دعاوی در دیوان یا از طریق شوراهای حل اختلاف یا حکمیت به رضایت دو طرف نیازمند است در غیر این صورت امکان طرح دعوا در مجامع بین‌المللی نیست زیرا در دادگاه‌های بین‌المللی با شکایت یک طرف و بدون رضایت طرف مقابل امکان طرح دعا نیست.

وی تاکید کرد: تا جایی که من اطلاع دارم دعاوی مطرح و احکامی از دادگاه درباره بعضی موارد در مقابل آمریکا به خاطر آثار بعضی از تحریم‌ها و اقدامات آن کشور علیه ایران گرفته شده است اما معاون حقوقی رئیس‌جمهور مدخلیتی ندارد.
