حقوق شهروندی از مهم ترین مباحث در کشور است
عباس شیخ الاسلامی رئیس دانشگاه آزاد اسلامی مشهد در جلسه ای که با عنوان قوه قضاییه و حقوق شهروندی و به همت دفتر سیاسی حزب کارگزاران سازندگی خراسان رضوی برگزار شد با تاکید بر اینکه قوه قضاییه نباید سیاسی باشد، گفت: دولت ها می آیند و می روند؛ قوه قضاییه باید تکیه گاهی برای همه دولت ها باشد.
وی تمایلات سیاسی را یکی از مشکلات قوه قضاییه دانست و افزود: در تمام دنیا مرسوم است که مدیران قضایی و قضات نباید مصاحبه کنند و همیشه باید بی طرفانه کار خود را انجام دهند.
رئیس دانشگاه آزاد اسلامی مشهد، خاطرنشان کرد: از مشکلات شهید بهشتی در بحث قوه قضاییه نیز حضور در حزب سیاسی بود که ایشان نباید وارد گروه ها و احزاب سیاسی می شدند و باید یک قوه مستقل تشکیل می دادند.
شیخ الاسلامی با تاکید بر اهمیت قوه قضاییه، تصریح کرد: نقش این قوه بسیار مهم است، اگر قوه قضاییه به رسالت خود عمل نکند، روی قوای دیگر تاثیر می گذارد.
شیخ الاسلامی با بیان اینکه سمن ها بازوی قضات هستند، عنوان نمود: طبق ماده ۶۶ آیین دادرسی کیفری، سازمان های مردم نهاد که در زمینه حمایت از اطفال، زنان، اشخاص بیمار یا ناتوان، محیط زیست، منابع طبیعی، بهداشت و یا حمایت از حقوق شهروندی فعالیت می کنند، می توانند نسبت به جرایم ارتکابی در زمینه های فوق اعلام جرم کنند.
وی خاطر نشان کرد: در زمان ریاست جمهوری خاتمی که شعار توسعه سیاسی را بیان نمود، آیت الله شاهرودی رئیس قوه قضاییه نیز شعار توسعه قضایی را عنوان کرد که در ادامه این جریان، حقوق شهروندی مطرح شد.
شیخ الاسلامی با تمجید از منشور حقوق شهروندی دکتر روحانی، گفت: تمام حقوق توسط یک تیم متخصص نوشته شده است، اما نداشتن ضمانت اجرایی یکی از مشکلات این منشور می باشد.
وی در ادامه افزود: حقوق شهروندی دکتر روحانی در حد یک منشور می باشد، تبدیل به قانون نشده است و ضمانت اجرایی ندارد، اگر مجلس دور بعد مفید باشند و به حقوق شهروندی عمیقا اعتقاد داشته باشد، می توانند منشور را تبدیل به قانون کنند.
رئیس دانشگاه آزاد اسلامی مشهد قدم بعدی پس از قانون شدن منشور حقوق شهروندی دکتر روحانی را فرهنگ سازی این منشور دانست و گفت: فرهنگ حقوق شهروندی نیز تنها مختص مردم نیست و مسئولین نیز باید فرهنگ را در خود داشته باشند.
