5 سال خداقل تعهد آمکریکا به برجام
پایگاه اطلاع رسانی «چندثانیه» در خبری اختصاصی نوشت : باقری مذاکره‌کننده ارشد برجام در نشستی خصوصی با خبرنگاران درباره مفاد توافق جدید ایران با ۱+۵ نکاتی را مطرح کرد:
۴ زمان اصلی احرایی توافق
▫️ روز جمع بندی: وزرای خارجه نهایی می‌کنند و امضا می‌شود. از همین روز ۳فرمان اجرایی ترامپ ویو می‌شود و نه لغو. همان نهادهای اقتصادی و ۱۷بانک هم در این روز از تحریم خارج می‌شوند.
▫️ روز تایید: ۶۰ روز بعد از روز جمع‌بندی می‌رسیم به روز تایید. این ۶۰ روز برای آن است که مجلس در کشور ما و طرف‌های مقابل کارهای لازم را انجام دهد و هر آنچه لازم است تصویب کند. عملا به جهت تصویب مجلس این ۶۰ روز به درخواست ما گنجانده شد.
▫️ روز باز اجرا: ۶۰ روز بعد لحظه‌ای است که اجرای برجام به طور کامل آغاز می‌شود. ۷ روز قبل از روز باز اجرا، ما طی نامه‌ای اعلام می‌کنیم که ما موافق باز اجرا هستیم و آماده‌ایم که کار را شروع کنیم. این روز از این جهت روز باز اجرا نامیده شد که بناست همان برجام دوباره شروع به کار کند. در این روز آن فرامین اجرایی که ویو شده بود به طور کامل لغو می‌شود. نکته دیگر اینکه مواد هسته ای ما قبل از روز باز اجرا در ایران است و خارج نمی‌شود.
▫️ روز تکمیل: ۴۵ روز بعد از روز باز اجرا همه طرفین باید اجرای تعهدات خود را تکمیل کرده باشند.
نحوه راستی‌آزمایی
* زمان راستی‌آزمایی ابتدا ۲۴ساعت بود. بعد شد ۳۰ ساعت و وقتی ما تحویل گرفتیم شده بود ۴۸ ساعت. ما با وزارت نفت و بانک مرکزی صحبت کردیم و گفتند واقعا شدنی نیست. طبق تدبیری که شد از روز جمع‌بندی که تحریم برخی نهادهای اقتصادی و ۱۷بانک برداشته می‌شود ما می‌توانیم راستی‌آزمایی را تا ۴ماه بعد انجام دهیم. از طرفی از فردای روز تایید تا روز باز اجرا هم فرصت اصلی راستی‌آزمایی است.
*اگر ما راضی نبودیم ۷ روز قبل از باز اجرا نامه می‌زنیم و مثلا می‌گوییم فلان موضوع حل نشده و توسط هماهنگ کننده می‌رود در جلسه کمیسیون مشترک (کمیسیونی که هنوز آمریکا عضو آن نیست) و تصمیم‌گیری می‌شود. نکته این است که کمیسیون همه چیز اجماعی است و اگر ما موافقت نکنیم عملا تصمیم اتخاذ نمی‌شود.
* ۱۶ محدودیت وجود دارد که همه اجماعی است به جز یک مورد آن هم موردی است که آژانس اعلام می‌کند دسترسی داشته باشد و ما نمی‌دهیم و اینجا اجماعی نخواهد بود. لذا برگشت پذیری از روز باز اجراست.
* در مورد اسنپ بک هم چون در برجام آمده است و هم در قطعنامه ۲۲۳۱ نمی‌شود که کلا حذف کنیم. فقط بنا شد کمی این ابزار رو معقول‌تر کنیم. قید و شرط آوردیم که این اتفاق زمانی ممکن است که مبتنی به گزارش آژانس باشد. اگر کشوری هم به طور نامعقول اسنپ‌بک کرد بقیه کشورها باید اقدام او را جبران کنند.
مدت تعهد آمریکا به خارج نشدن از برجام
* نکته مهم این است که طرف مقابل تا پایان دوره اول بایدن قطعا از برجام خارج نخواهد شد. از طرفی اگر فردای انتخابات آینده رئیس جمهور آینده بخواهد از برجام خارج بشود طبق توافق باید ۳ سال بگذرد و این با ۲ و نیم سال آینده دوره بایدن می شود ۵ و نیم سال.
تبادل زندانی ها
*تبادل زندانی هم در زمان آقای عراقچی نهایی شده بود. یک سند هم در زمان ما نهایی شد و آماده ایم اجرا کنیم. خود آمریکایی تعلل کردند و موکول شد به آینده.
