فساد؛ از عاملان شبه‌مذهبی تا منکران قضایی

چندی است که برگزاری دادگاه علنی اکبر طبری، معاون اجرایی سابق حوزه ریاست قوه قضاییه بر سر زبان‌های افتاده است. گفت‌وگوها و دفاعیاتی که وی از خود ارائه می‌دهد نشانگر کاهش قبح فساد در جامعه است. او در بسیاری از دفاعیاتش، خود را بری از اتهامات وارده چون پولوشویی، دریافت رشوه و… می‌داند. از سویی دیگر اظهارات او مبنی بر پرداخت رشوه به قاضی غلامرضا منصوری نشانگر ابعاد گوناگون فساد در این حوزه است. هر چند که در مدت زمان اخیر برخی افرادی که دارای سمت‌های دولتی هستند نیز نامشان به عنوان مجرم اقتصادی مطرح شده، کسانی چون محمد عزیزی و فریدون احمدی، دو نماینده سابق مجلس شورای اسلامی که به جرم ایجاد اخلال و فساد در حوزه خودرو بازداشت شدند. مطرح شدن نام این افراد و تأثیری که در گسترش فساد اقتصادی در جامعه داشتند، منجر شد تا به بررسی علل ایجاد فساد در جامعه و راهکارهای موجود برای حل آن بپردازیم.
براساس پژوهش‌های صورت گرفته «عدم پایبندی مذهبی و اخلاقی در افراد زمانی که با عدم وجدان کاری و اخلاق حرفه‌ای همراه باشد، عدم اعتماد نهادی با کاهش رضایت شغلی، تعهد سازمانی، کاهش اطمینان و ایجاد انحراف شغلی، عدم شفاف‌سازی و گردش آزاد اطلاعات به علت عدم آزادی‌های مدنی، وجود نظام خویشاندپروری اداری با به وجود آوردن امور خلاف قانونی چون اختلاس، پارتی‌بازی، فروش اطلاعات محرمانه سازمان و نظایر آن، عدم قبح فساد از طریق تبدیل آن به یک ارزش در جامعه می‌توانند زمینه‌ساز رواج فساد اقتصادی و اداری باشند»(منصوری و همکاران، 1397: 101).
«فساد اقتصادی و اداری را می‌توان یکی از نتایج اجتناب‌ناپذیر رشد نامتوازن اقتصادی دانست. شرایطی که دولت به‌عنوان اصلی‌ترین بازیگر اقتصادی تلقی می‌شود، طبعاً امکان ضابطه‌زدایی اقتصادی از سوی نیروهای دولتی افزایش می‌یابد. این امر منجر به فساد اقتصادی و اداری گردیده و زمینه را برای ظهور جلوه‌هایی ازرضایت محدود وناپایدار فراهم می‌سازد»(مصلی‌نژاد، 1384: 21).
فساد اقتصادی و اداری؛ عامل بازدارنده از رشد اقتصادی و ناپایداری سیاسی
«در نتیجه پیامدهای اقتصادی، شیوع فساد اقتصادی و اداری در کشورها می‌تواند شامل ضد رشد و توسعه بودن مفاسد مالی ایجاد و گسترش فقر و آثار و پیامدهای آن و نیز تغییر فرهنگ اقتصادی شود». گلد معتقد است که این نوع فساد از مهمترین عوامل بازدارنده رشد اقتصادی و ناپایداری سیاسی به‌ویژه در کشورهای درحال توسعه است.
ازبین رفتن اعتماد مردم نسبت به دستگاه‌های دولتی و غیردولتی
گفتنی است «فساد اقتصادی و اداری، سیاست‌های دولت را در تضاد با منافع اکثریت قرار می‌دهد، باعث هدررفتن منابع ملی می‌شود و به کاهش اثربخشی دولت‌ها در هدایت امور می‌انجامد و از این طریق اعتماد مردم نسبت به دستگاه‌های دولتی و غیردولتی کاهش یافته و بی‌تفاوتی، تنبلی و بی‌کفایتی افزایش می‌یابد»(منصوری و همکاران، 1397: 102).
بزرگ بودن دولت، منجر به بیشتر شدن رانت‌جویی سیاسی می‌شود
«برخی از صاحبنظران معتقدند که بین فساد اقتصادی و اداری و اندازه دولت رابطه وجود دارد. افزایش در اندازه دولت فرصت بیشتری را برای رانت‌جویی سیاسی فراهم می‌کند و سیاست‌مداران و بوروکرات‌ها فاسدتر می‌شوند. به عبارتی دیگر دولت بزرگتر سبب افزایش بازده مورد انتظار فعالیت‌های غیرقانونی می‌شود و منجر به انگیزه‌هایی برای انجام فعالیت‌های غیرقانونی بیشتر مانند فساد می‌گردد»(همان. 102).
رتبه 146 ایران در شاخص شفافیت از مجموع 180 کشور
باید توجه داشت که وضعیت فساد در ایران به‌گونه‌ای است که شاخص شفافیت کشور در حال تنزل است. طبق گزارش سازمان شفافیت بین‌الملل «ایران با نمره ۲۶ در کنار کشورهای آنگولا، بنگلادش، گوآتمالا، هندوراس، موزامبیک و نیجریه که همگی همین نمره را در فسادزدایی گرفته‌اند، رتبه ۱۴۶ را از میان ۱۸۰ کشور به خود اختصاص داده است. این در حالی است که در سال گذشته رتبه ایران ۱۳۸ و نمره آن ۲۸ بود که حکایت از ۸ پله افت رتبه و ۲ نمره کاهش در کارنامه امسال ایران نسبت به سال گذشته دارد. این در شرایطی است که در سال ۲۰۱۷ رتبه ایران ۱۳۰ و نمره آن ۳۰ بود. به این ترتیب به‌طور مداوم طی این سال‌ها جایگاه و نمره ایران در مبارزه با فساد در حال تنزل بوده است(دنیای اقتصاد، بهمن 1398).
دورکهایم معتقد است که انسان‌ها درنتیجه شرایط اجتماعی خاص اقدام به رفتارهای نابهنجار می‌کنند نه تحت شرایط روانی فردی‌شان. او از این شرایط حاد با عنوان بی‌هنجاری اجتماعی یاد می‌کند. از نظر دورکهایم، بحران های اقتصادی یا رشد سریع اقتصادی باعث دست‌یابی عده‌ای به یک ثروت ناگهانی می‌شود.
«دست‌یابی به ثروت یک عده درواقع به قیمت فقر عده زیاد دیگر در جامعه است. فقرا نیز با مشاهده وضعیت خوب ثروتمندان احساس نیاز بیشتری می‌کنند. بدین ترتیب فقر برای آن‌ها غیرقابل تحمل می‌شود. بنابراین در مشاهده فقر خود و ثروت دیگران تعادل افراد به هم می‌خورد و پذیرش این وضعیت برایشان دشوار می‌شود. بدین ترتیب آن‌ها از وضعیت موجود ناراضی می‌شوند و به کارهای خلاف(فساد اقتصادی) روی می‌آورند»(منصوری و همکاران، 1397: 103).
تعلق خاطر افراد به جامعه؛ عاملی برای کاهش کج‌رفتاری
«اعتقاد افراد به اعتبار اخلاقی نظام هنجارهای اجتماعی و رعایت قوانین و مقررات نیز موجب احساس وظیفه اخلاقی نسبت به دیگران می‌شود و ضعف چنین اعتقادی راه را برای کج‌رفتاری هموار می‌کند. بنابراین بین تعلق خاطر افراد به جامعه و تعهد آنان به امور متداول و زندگی روزمره هم‌نوایی با هنجارهای اجتماعی و اعتقادشان به نظام هنجاری جامعه از یک سو و هم‌نوایی آنان با هنجارهای اجتماعی از سوی دیگر رابطه مستقیم و با احتمال کج‌رفتاری آنان رابطه معکوس دارد»(همان. 105).
سیستم کنترل بیرونی مانع از بروز جرم اقتصادی می‌شود
درواقع جامعه‌شناسان معتقدند «هنگامی که یک شخص به یک عمل خلاف مثلاً گرفتن رشوه دست می‌زند که ارزش به دست آوردن آن پول برایش زیاد و انتظار دستگیری‌اش کم و انتظار موفقیتش زیاد باشد. بر این اساس سیستم کنترل بیرونی باید دارای دو خصوصیت باشد: اولاً احتمال کشف کار خلاف؛ یعنی حضور سیستماتیک نیروهای کنترل‌کننده بسیار زیاد باشد، به‌طوری که شخص خاطی بداند که به احتمال بسیار زیاد مجازات خواهد شد. ثانیاً میزان مجازات برای یک کار خلاف باید بسیار سنگین باشد تا برای شخص خاطی پرهزینه و پر ضرر تلقی شود و از نظر او دست زدن به آن کار به هیچ وجه مقرون به صرفه نباشد».(منصوری و همکاران، 1397: 105).
اما راهکارهای مورد نیاز برای حل فساد اقتصادی و اداری موجود در جامعه چیست؟
- «رویکردهای سیاست ضد فساد را می‌توان به پنج گروه تقسیم کرد: 1. رویکرد کنترل اجرایی و قضایی که براساس آن سیاست ضد فساد شامل ایجاد و تقویت قوانین قضایی مؤثر و ایجاد نظام کنترلی در دولت است.
- رویکرد دولت کوچک: این رویکرد بیان می‌کند که خود دولت یک مشکل است. درواقع طرفداران این دیدگاه، سیاست ضد فساد را متشکل از سیاست‌هایی برای کاهش نقش دولت و قوانین می‌دانند»(جعفری، شریف‌نیا، 1394: 5).
ثبات اقتصادی در کاهش میزان فساد مؤثر است
3. رویکرد اقتصادی-سیاسی: در این رویکرد فرض بر این است که فساد، ناشی از ناتوانی مدیران در نظارت مؤثر بر مرئوسین است. طرفداران این دیدگاه تنها بر اندازه دولت متمرکز نشده‌اند، بلکه بر شکل‌دهی مجدد برنامه‌های دولت برای افزایش شفافیت، پاسخگویی و کاهش مشکلات رئیس-مرئوس متمرکز شده‌اند. در این رویکرد برای مبارزه با فساد تنها نباید با فساد مبارزه کرد، بلکه باید ثبات اقتصادی که در آن اتفاق می‌افتد را دنبال کرد»(همان).
4. راهبردهای چند جهته(رویکرد سیستم سالم): تحقیقات نشان می‌دهد که بسیاری از برنامه‌های ضد فساد در جهت شکل‌دهی مجدد مدیریت مالی و دولتی بوده است، در صورتی که ریشه‌های فساد اداری گسترده است و باید برای مبارزه با آن راهبردهای چند جهته را در نظر گرفت. اهداف این رویکرد شامل افزایش ظرفیت دولت و مدیریت بخش دولتی، تقویت پاسخگویی سیاسی، توانمندسازی جامعه مدنی و افزایش رقابت اقتصادی می‌شود. 5.رویکرد مبتنی بر بی‌عیبی(سلامت) دولت: در این رویکرد دولت تمایل به ایجاد سلامت در ساختار خود دارد. بر مبنای این پیش‌فرض کارکنان دولت می‌توانند انگیزه مثبت برای رفتار سالم و انگیزه منفی برای جلوگیری از رفتارهای مفسدانه داشته باشند(همان. 5).
