خودمختاری در حاشیه خیابان
هنگام عبور از خیابان سروصدای درگیری یک مغازه دار با صاحب خودروییکه روبروی مغازه پارک کرده است توجهم را جلب می کند. گویا مغازه دار از پارک خودرو جلوی مغازه اش ناراضی است و با اصرار می خواهد خودروی پارک شده جابجا شود. صاحب خودرو با ناراحتی می گوید: “این فضا بخشی از خیابان است و نمی توان مانع پارک خودروها شد.” از طرفی مغازه دار که سعیدر قانع کردن طرف مقابل دارد مدعی می شود که مجوز آن را از شهرداری گرفته و پارک در این مکان غیرقانونی است.
حتما شما هم تابحال مغازه هایی را دیده اید که با گذاشتن سبد و مانع در فضای روبروی مغازه از پارک خودروها جلوگیری می کنند و یا حتی باعث درگیری می شوند.این مسئله بهانه ای می شود تا با تعدادی از مردم و مغازه داران در این باره گفت و گو کنم و درستی ادعای هر کدام را از شهرداری و اداره راهنمایی و رانندگی مشهد جویا شوم. گزارش ما را از پیگیریوضعیت تصرف خیابان توسط برخی واحدهای صنفی می خوانید.
پارک خودروها دید مغازه ام را کم می کند
برای گفت و گو با مردم و مغازه داران به خیابان های پرترافیک مشهد سری میزنم. صاحب یک میوه فروشی در خیابان کلاهدوز مانع از توقف خودروها مقابل مغازه اش شده است، اومی گوید: “برای جلوگیری از پارک خودروها جلویمغازه ام سبد می گذارم؛ پارک خودروها دید مغازه ام را کم می کند و علاوه بر آن برای تخلیه بار با مشکل مواجه می شوم.”
این شهروند ادعا می کند با توجه به این که عوارض و مالیات می دهد بایدمغازه اش از حاشیه خیابان دید کافی داشته باشد.
ادعای دریافت مجوز از شهرداری
صاحب یک سوپرمارکت در خیابان امامت نیز مدعی می شود مجوز ممنوعیتپارک در فضای جلوی مغازه اش را از شهرداری گرفته است ، او دلیل آن را سهولت بیشتر در تخلیه بار عنوان می کند.
به سراغ مردم می روم و با صاحب خودرویی که درحال پارک کنار همین مغازه است گفت و گو می کنم. او می گوید: “هرروز برای پارک در این خیابان با مشکل مواجه ام. برخی مغازه داران به بهانه تخلیه بار اجازه پارک جلوی مغازه شان را نمی دهند. تخلیه بار در نهایت روزی دو بار صورت می گیرد اما اینسبدها همیشه جلوی مغازه ها وجود دارد.”
شهروند دیگری می گوید: “برخی از مغازه دارها معتقدند پارک خودرو جلویدید مغازه را می گیرد و برای جلوگیری از این مسئله از شهرداری مجوز گرفته اند. قراردادن این سبدها علاوه بر ایجاد درگیری فضای شهر را نیززشت کرده است. مردم هم دیگر کمتر به این مسئله واکنش نشان می دهد.”
قانون چه می گوید؟
درماده 55 قانون شهرداری ها آمده است: سد معابر عمومي و اشغال پياده روها و استفاده غير مجاز آنها و ميدان ها و پارك ها و باغ هاي عمومي براي كسب و يا سكني و يا هر عنوان ديگري ممنوع است و شهرداري مكلف است از آن جلوگيري و در رفع موانع موجود و آزاد نمودن معابر و اماكن مذكور فوق بوسيله مأمورين خود رأساً اقدام كند. در مورد دكه هاي منصوب قبل از تصويب اين قانون، شهرداري مكلف است نسبت به برداشتن آنها اقدام وچنانچه صاحبان اين قبيل دكه ها ادعاي خسارتي داشته باشند با نظر كميسيون مقرر در ماده۷۷ نسبت به جبران خسارت آنها اقدام كند ولي كساني كه بعدازتصويب‌اين‌قانون‌اقدام‌به‌نصب دكه‌هائي در معابر عمومي كنند شهرداري موظف است رأساً و بوسيله مأمورين خود در برداشتن اين قبيل دكه ها و رفع سد معبر اقدام كند و اشخاص مزبور حق ادعاي هيچگونه خسارتي نخواهند داشت.
محدوده واحدهای صنفی فقط تا درب مغازه است
در بررسی ها مشخص شد که شهرداری با کسبه ای که معبر را اشغال می کنند برخورد می کند ، برای اطلاع از اقدامات شهرداری با مدیرکل هماهنگی و نظارت بر خدمات شهری شهرداری مشهد گفت و گو می کنم. علیرضا صحراگرد با تاکید بر غیرقانونی بودن تصرف معابر می گوید: “محدوده واحدهایصنفی فقط تا درب مغازه است و هیچ واحدی حق سدمعبر پیاده رو یا سواره رو را ندارد؛ حتی درب مغازه ها نباید رو به پیاده رو باز شود.”
مجوز شهرداری برای پیاده روها و مشروط به استفاده در ساعات پایانی شب است
صحراگرد در رابطه با ادعای برخی واحدهای صنفی برای داشتن مجوز سدمعبر نیز می گوید: “این مجوز طبق مصوبه شورای اسلامی شهر مشهد توسط سازمان میادین فقط برای معابر پیاده رو ارائه می شود و مشروط به ساعات پایانی شب است؛ به طوری که مشکلی برای عابران پیش نیاید ما سعیکرده ایم به این وسیله شهر را زنده نگه داریم تا امنیت بیشتری در ساعات پایانی شب برقرار شود.”
صحراگرد با با دعوت از مردم برای همکاری با شهرداری ادامه می دهد: “واحدهای گشت سدمعبر پیوسته درحال انجام ماموریت هستند اما در صورت مشاهده تخلف مردم می توانند به سامانه 137 اطلاع دهند تا موضوع پیگیریشود.”
پلیس پاسخ نداد!
اگر چه بخشی از تصرف خیابان توسط برخی کسبه به پلس راهنمایی و رانندگی مرتبط است اما امکان دریافت پاسخ پلیس راهنمایی و رانندگیمشهد فراهم نشد.
