از حاشیه‌نشینی تا فقدان آینده‌ای روشن
مردم افغانستان به دلیل مشکلات داخلی و خارجی موجود در کشورشان بخش بزرگی از مهاجران اجباری جهان را تشکیل می‌دهند و به دلیل همجواری و اشتراک‌های فرهنگی و تاریخی، ایران پس از پاکستان دومین کشور مقصد مهاجران افغانستانی است. حضور آنها به ویژه زنان و دخترشان آسیب‌هایی هم برای آنان به همراه داشته و دارد و اکنون که طالبان بار دیگر بر افغانستان سلطه یافته اهمیت این امر بیشتر می‌شود.
به گزارش روزنامه «صبح امروز» به نقل از برنا، سلطه طالبان در افغانستان باعث شده تعداد زیادی از مردم از جمله زنان و نظامیان این کشور فرار کرده و از هر راهی برای خروج از کشور خود استفاده کنند، اما سوالی که اذهان را به خود درگیر می‌کند این است که سرنوشت زنان افغان و آینده‌شان چه می‌شود؟ اگر جامعه جهانی بار دیگر افغانستان را رها کند، حقوق زنان در معرض خطر قرار می‌گیرد و باید شاهد آینده‌ای تلخ برای زنان افغان بود. ایران یکی از کشورهایی است که همواره میزبان اتباع افغانستان بوده، اما نمی‌توان از آسیب‌ها و مشکلات حضور آنها در ایران چشم پوشید؛ مشکلاتی که اتفاقا بیشتر گریبان‌گیر همین زنان است.
آسیب‌های مهاجرت غیرقانونی زنان افغان به ایران
به سراغ امیرمحمود حریرچی، آسیب‌شناس اجتماعی و عضو هیات علمی دانشگاه علامه طباطبایی رفتیم تا از سال‌ها تجربه او در این حوزه پرس‌وجو کنیم. او به آثار حقوقی و قضایی، تابعیت، ازدواج، کار و اشتغال مهاجران افغانستانی در ایران پرداخت.
حریرچی می‌گوید: مهاجرت افغان‌ها به ایران سابقه‌ای دیرینه دارد به ویژه طی سال‌های پس از انقلاب اسلامی که ایران میزبان بزرگترین جمعیت پناهنده افغانستانی بوده است. موج اولیه این مهاجرت، پس از اشغال افغانستان توسط اتحاد جماهیر شوروی صورت گرفت و در این دوران مهاجران در شهرهای مختلف ساکن شدند و در کنار سایر مردم زندگی کرده و از بسیاری از حقوق و مزایا برخوردار بودند، اما آنچه بیشتر از همه مشکل‌ساز شد، ورود و حضور غیرقانونی گروه وسیعی از افغان‌ها در ایران بود که پیامدهای بسیاری در حوزه اقتصادی، فرهنگی، سیاسی و امنیتی ایجاد کرد.
این جامعه‌شناس با اشاره به مشکلات حقوقی و قضایی مهاجران غیرقانونی گفت: حضور غیرقانونی مهاجران افغانستانی در وهله اول به معنای زیر پا گذاشتن قوانین ایران است؛ چون از همان ابتدا قوانین حقوقی مربوط به اقامت ورود را رعایت نکرده‌اند؛ بنابراین همین سکوت غیرقانونی، زمینه چالش‌های حقوقی دیگری را فراهم می‌کند که اول از همه، زمینه قانون‌شکنی‌های دیگر را تسهیل می‌کند. به عبارتی ازدواج، کار و تحصیل آنها در ادامه نیز به صورت غیرقانونی انجام می‌شود که هم برای خودشان و هم کشور ایران مشکل ایجاد می‌کند.
قاچاق شناسنامه؛ از تبعات ورود غیرقانونی مهاجران به ایران
او می‌گوید اگر مهاجری که به صورت غیرقانونی در یک کشور ساکن است، جرمی مرتکب شود به راحتی می‌تواند اقدام به خروج از آن کشور کرده و بررسی و پیگیری آن برای دستگاه قضایی مشکل است و این خود زمینه افزایش جرایم را در یک کشور فراهم می‌کند. حتی برخی از افرادی که به صورت غیرقانونی در کشور حضور دارند برای ماندن در ایران اقدامات مختلفی انجام می‌دهند که از جمله این اقدامات خرید شناسنامه افراد ایرانی متوفی، مفقودی و المثنی است که این امر باعث ایجاد قاچاق شناسنامه می‌شود.
تحمیل هزینه‌های اقتصادی و فرهنگی بر دستگاه‌های حقوقی ایران
این آسیب‌شناس درخصوص آسیب‌های اشتغال افغان‌ها در مشاغل غیرقانونی بیان کرد: برخی از مهاجران افغانستانی جهت امرار معاش دست به مشاغل غیرقانونی مانند دست‌فروشی، دوره‌گردی، تکدی‌گری در اماکن عمومی، خرید و فروش لباس‌های دست دوم و حتی دخالت در امر قاچاق مواد مخدر می‌کنند که غیرقانونی است و برای کشور ما نیز مشکلاتی ایجاد می‌کند. بنابراین حضور غیرقانونی مهاجران افغان از جمله زنان هزینه‌های اقتصادی و فرهنگی بر دستگاه‌های حقوقی ایران تحمیل می‌کند.
به گفته حریرچی تصویب قوانین و مقررات در حوزه تابعیت، ازدواج و اشتغال آنان ضرورت دارد؛ چراکه ممنوعیت آنها از تحصیل و بسیاری از امور دیگر از مهمترین مشکلات آن‌هاست.
ما باید با دولت افغانستان حال چه طالبان باشد چه دولت دیگر، در قالب یک معاهده تعامل کنیم یعنی امتیازاتی از آنها بگیریم و امتیازاتی را به آنها بدهیم. برای مثال آنها را موظف کنیم به معاهده 1351 عمل کنند، مشکل بسته شدن آب هیرمند را حل کنند
این جامعه‌شناس به مشکلات حوزه اشتغال افغان‌ها اشاره کرد و گفت: کارگران افغان عرضه نیروی کار ایران را افزایش دادند به همین دلیل افزایش دستمزد کارگران به ویژه در بخش ساختمان بسیار کند بوده است. در کل حضور افغان‌ها چه مردان و چه زنان آنها در بازار کار ایران، به نفع کارفرمایان و به زیان کارگران غیرماهر ایرانی بوده است.
حریرچی به مسئله تابعیت کودکان حاصل از ازدواج زنان ایرانی و مردان افغانستانی اشاره کرده و می‌گوید: یکی از مهمترین چالش‌هایی که حضور غیرقانونی افغان‌ها به دنبال داشته، این است که آنها اغلب به ازدواج با زنان ایرانی اقدام کرده‌اند. براساس قوانین تنها زمانی‌آثار قوانین و مزایای اجتماعی ناشی از ازدواج بیگانه با زن ایرانی حاصل می‌شود که روند مشخص شده در قوانین جمهوری اسلامی ایران در رابطه با چنین ازدواج‌هایی طی شود.
به گفته وی، اغلب این افراد زمانی که با دختران ایرانی ازدواج می‌کنند هیچ یک از مراحل قانونی را که برای ازدواج اتباع بیگانه با بانوان ایرانی در نظر گرفته شده اجرا نمی‌کنند؛ بنابراین ازدواج‌شان به صورت قانونی در دفاتر اسناد رسمی ایران ثبت نمی‌شود. هرچند که چنین ازدواجی شرعی است، اما قانونی نیست و اگر بچه دار شوند دچار مشکل خواهند شد چرا که برای صدور شناسنامه فرزند، ثبت ازدواج والدین لازم است.
این جامعه‌شناس در توضیح بیشتر مشکل تابعیت مهاجران می‌گوید: اگر پدر طفلی، غیرایرانی باشد مشکل بیشتر خواهد شد. طبق قانون مدنی، ازدواج اتباع خارجی با زنان ایرانی باید با اطلاع دولت باشد و اجازه مخصوص دولت ایران برای ازدواج زنان ایرانی با اتباع خارجی لازم است؛ بنابراین فرزندان زن ایرانی که به واسطه ازدواج با مرد خارجی، تابعیت ایرانی خود را از دست داده از داشتن شناسنامه ایرانی محروم خواهند شد که البته یکسالی است قانونگذار این مشکل را رفع کرده و درحال صدور شناسنامه برای این فرزندان است.
این آسیب شناس، آسیب‌پذیر شدن امنیت مناطق مرزی را از مشکلات دیگر حضور افغان‌ها در ایران دانست و بیان می‌کند: ورود و خروج غیرقانونی مهاجران، باعث پایین آمدن ضریب امنیت در مرزها می‌شود و مشکلات امنیتی و سیاسی بسیاری برای کشور ایجاد می‌کند. گسترش هرج و مرج در مرزها کنترل مرزها را دشوارتر می‌کند و دولت باید هزینه زیادی برای تأمین امنیت این مناطق پرداخت کند. مسئله دیگری که ورود و خروج غیرقانونی این مهاجران به دنبال دارد این است که اغلب این افراد مخفیانه و به صورت قاچاقی و غیرقانونی وارد ایران می‌شوند و مسئله قاچاق انسان را ایجاد می‌کنند.
حاشیه‌نشینی؛ از تبعات حضور افغان‌ها در ایران
حریرچی تصریح می‌کند: حاشیه‌نشینی از جمله تبعات منفی حضور غیرقانونی افغان‌ها در ایران است و همین مسئله برای زنان و کودکان افغان بیشتر از مردان، آسیب زاست. وجود منازل مسکونی با اجاره‌‌بهای کمتر از نقاط مرکزی شهر، دور بودن از قوانین و مقررات سختگیرانه حاکم در مرکز شهر، اشباع نقاط مرکزی شهر از جمعیت و … از دلایلی است که باعث می‌شود آنها در این مناطق زندگی کنند که هم برای خودشان و هم کشور مشکل ایجاد می‌کند.
این جامعه‌شناس معتقد است افغان‌ها باعث تغییر در ساختار و ترکیب جمعیت ایران می‌شود چون در ایران سن ازدواج بالا رفته، خانواده‌ها اغلب تمایل به داشتن یک یا دو فرزند دارند، اما دختران افغان زود ازدواج می‌کنند و گرایش به داشتن فرزندان بیشتر دارند.
او می‌گوید: نه تنها مسئله نداشتن تابعیت مهاجران غیرقانونی باعث بی‌سوادی در بین آنها شده، بلکه مسائلی همچون عدم تأمین امکانات تحصیل فرزندان، فقر اقتصادی و ضرورت اشتغال همه افراد خانواده و جابه‌جایی زیاد از شهری به شهر دیگر باعث شده که این گروه از مهاجران نتوانند از سواد و آموزش مناسبی برخوردار شوند.
حریرچی می‌گوید که مهاجران غیرقانونی از احقاق حقوق محروم هستند. البته حضور غیرقانونی افغان‌ها موضوعی نیست که پیامدهای آن تنها دامن کشور و دولت ایران را بگیرد، بلکه در درجه اول خود افغان‌ها از حقوق بسیاری محروم می‌شوند و علاوه بر این توانایی احقاق حقوق خود را ندارند.
این جامعه‌شناس در انتقاد از حقوق بشر به دلایل عدم توجه به مهاجران توضیح می‌دهد: نهادهای حقوق بشر بدون توجه به سابقه طولانی حضور افغان‌ها در ایران و بدون در نظر گرفتن شرایط اقتصادی، اجتماعی و فرهنگی این کشور در گزارش‌های حقوق بشری ادعایی بی اساس مطرح می‌کنند. برای مثال ایران را به نژادپرستی و پاکسازی قومی متهم کرده‌اند در حالی که طی سال‌های بسیاری، مهاجران افغان در کنار مسلمانان ایران با حقوقی مطلوب زندگی کرده و کشور ایران پس از تغییر شرایط و فراهم شدن نسبی زندگی در افغانستان، مهاجران افغان را به ادامه زندگی در کشور خود ترغیب کرده است.
دولت ایران با افغانستان باید درخصوص مهاجران تفاهم نامه منعقد کند
صفت الله شمیرانی، دیپلمات سابق وزارت امور خارجه در گفتگویی که درباره همین موضوع با داشت حضور غیرقانونی افغان‌ها را عامل معضل اجتماعی دانست و تشریح می‌کند: عدم ساماندهی مهاجران افغانستانی و سکونت غیرقانونی آنها باعث شده شاهد حضور زنان و کودکان افغان بر سر چهارراه‌ها باشیم که این موضوع بیشتر به ضرر کشور ماست. در میان متکدیان چهارراه‌ها، زباله گردها و دست فروشان زنان و کودکان اتباع این کشور به وفور دیده می‌شود که راه حل آن ساماندهی و توافق با دولت افغانستان است.
عدم مدیریت درست در ساماندهی اتباع افغان در ایران
شمیرانی پاس‌کاری و عدم مدیریت درست در ساماندهی اتباع افغان را عامل وضعیت کنونی دانست و بیان می‌کند: مشکل تشکلات امور داخلی ما هستند که به درستی در امر ساماندهی اتباع افغان کار نمی‌کنند و دائما امور را بین خودشان پاس‌کاری می‌کنند درحالی که می‌توان وضعیت حضور افغان‌ها در کشور را سامان بخشید برای مثال شرایط یکسان تحصیل را برای کودکانشان به وجود آورد، برای مردهایشان شغل قانونی در نظر گرفت تا زنان و کودکانشان مجبور به اشتغال در مشاغل غیررسمی که آسیب اجتماعی هستند، نشوند.
لزوم تعامل ایران با افغانستان چه طالبان چه دولتی دیگر
این دیپلمات سابق وزارت امور خارجه با تاکید بر اینکه باید با دولت افغانستان تعامل کرد، می‌گوید: ما باید با دولت افغانستان حال چه طالبان باشد چه دولت دیگر، در قالب یک معاهده تعامل کنیم یعنی امتیازاتی از آنها بگیریم و امتیازاتی را به آنها بدهیم. برای مثال آنها را موظف کنیم به معاهده 1351 عمل کنند، مشکل بسته شدن آب هیرمند را حل کنند. درمقابل ما نیز به آنها امتیازاتی دهیم یعنی از مهاجران آنها محافظت کنیم، ترانزیت کالا از بند چابهار را تسهیل کنیم، گذرگاه‌های مرزی را ساماندهی کنیم درواقع به اعتقاد بنده به عنوان کارشناس، درخصوص کشور افغانستان نیازمند یک پکیج جامع تحت عنوان دیپلماسی قوی هستیم.
او معتقد است در موضوع افغانستان ما باید ارتباط دوجانبه داشته باشیم چرا که اگر غیر از این باشد، ایران بدهکار خواهد شد.
شمیرانی با تاکید بر اینکه بیش از 1 و نیم میلیون مهاجر در ایران زندگی می‌کنند، گفت: به اعتقاد بنده ما باید یک سیاست راهبردی کوتاه مدت تدوین کنیم تا هر مهاجر افغانی که در کشورمان زندگی می‌کند را ساماندهی کرده و به آنها خدمات دهیم تا جلوی آسیب‌های اجتماعی مانند زنان و کودکان کار گرفته شود. درواقع با افغانستان تفاهم‌نامه‌ای منعقد کرده و مشخص کنیم هرساله برای مثال 20_30 هزار مهاجر می‌تواند وارد کشور ما شود و ما نیز آنها را تحت پوشش قرار می‌دهیم.
زنان افغان نیازمند حامی و کمک هستند
براساس آخرین آمار بیش از یک‌و‌نیم میلیون نفر در ایران غیر قانونی حضور دارند که اگر به این تعداد، مهاجران قانونی و همچنین مهاجران پاکستان را اضافه کنیم تعداد قابل توجهی خواهند بود. نمی‌توان انکار کرد که نخبگان دانشگاهی و حوزوی افغانستانی که در ایران تحصیل کرده‌اند و اتفاقا زنان بخش عمده‌ای از آن را تشکیل می‌دهند نقش بسیار مهمی دارند اما باید با سازماندهی افغان‌ها و ترغیب آنها برای بازگشت به وطنشان آنها را تشویق کرد تا نقش مهمی در تعیین سرنوشت خود ایفا کنند. به هر حال مسئله حضور غیرقانونی افغانستانی‌ها به ویژه زنان موضوعی است که حل آن نیازمند همکاری دولت ایران و افغانستان و همچنین سازمان‌های غیردولتی‌ست و باید با رعایت حسن همجواری به آنها به ویژه زنانشان که در طول دهه‌های اخیر به شدت آسیب دیدند کمک کرد.
