ورود به فرماندار به مسئله تحصیل مهاجران
معاون دادستان در امور اجتماعی و پیشگیری از وقوع‌جرم خراسان‌رضوی گفت: طی مکاتبه‌ای با فرمانداری مشهد درخواست شده که ضمن نظارت جدی بر ثبت نام مهاجران، حس عدم تعلق را از بین برده تا کودکان بتوانند بهتر و راحت‌تر به تحصیل مشغول شوند.
به گزارش روزنامه «صبح امروز»، محمد بخشی محبی در مصاحبه با خبرنگار این روزنامه پیرامون حق تحصیل رایگان، افزود: طی چند ماه اخیر افرادی با مراجعه به مراکز قضایی و گزارش خطای مدارس در خصوص عدم رعایت قانون آموزش رایگان درخواستنی مبتنی بر رسیدگی به این موارد را داشتند.
وی تصریح کرد: با توجه به ماه مهر و شروع سال تحصیلی در چندماه گذشته نیز افرادی به دادگستری مراجعه کرده و از مدارسی که فرزندان این افراد را به دلیل نداشتن مدارک شناسایی ثبت‌نام نکرده را گزارش داده که این یکی از مواردی بوده که در چهارچوب و جزئی از قوانین و ضوابط مدارس است و باید این روال بر اساس قانون مدارس اتفاق بیفتد.
بخشی محبی اظهار داشت: اما سوال اینجاست آیا فردی که فاقد شناسنامه باشد باید از تحصیل منع شود و نتواند خدمات آموزشی که حق او است را دریافت کند که ما به عنوان یک مسئول حقوق عامه هستیم و نباید اشخاص و افرادی که در ایران اقامت می‌کنند از این حق طبیعی خود باز بمانند.
تفویض قائل نشویم
وی عنوان‌کرد: زمانی‌که یک کودک هم‌سالان خود را که تا چندماه قبل باهم بازی می‌کردند و حالا او به مدرسه رفته و این کودک نمی‌تواند به مدرسه برود، را می‌بیند این موضوع باعث بروز حس‌بد و احساس انتقام در درون این کودک می‌شود و ممکن است در آینده این فرد هم به خود و هم به جامعه آسیب‌های جبران ناپذیری وارد کند.
بخشی محبی ادامه داد: آموزش و حتی آموزش رایگان حق همه افرادی است که در ایران اقامت کرده و زندگی می‌کنند واین افراد می‌توانند تا پایان دوره متوسطه از این خدمات آمدزشی رایگان بهره ببرند .
وی با طرح سوال چرایی عدم توانایی عده‌ای از افراد در بهره‌گیری از این خدمات آموزشی توضیح داد: این روزها واکنون خوشبختانه با ورود فرمانداری به حوزه پیگیری تحصیل کودکان بی‌هویت و فاقد اوراق شناسایی در این سازمان کارگروهی تشکیل شده که سعی بر دسته بندی این افراد دارند تا با شناسایی افرادی که فاقد هویت بوده و نیز هیچ پرونده‌ای در فرمانداری تشکیل نشده پرونده‌ای برای احراز هویت ایحاد و بررسی کنند.
نداشتن اوراق هویتی معضل است
بخشی محبی گفت: امروزه یکی از معضلاتی که در رابطه با این افراد بی هویت و فاقد مدارک شناسایی وجود دارد این است که این فردی که در ایران اقامت دارد تابع چه کشوری بوده و مطابق قانون حق تابعیت یکی از حقوق افراد است که باید مشخص و محرز شود که این فرد تبعیت ایران یا کشور دیگری را دارد.
وی تشریح کرد: این عدم محرز بودن تابعیت افراد یکی از معضلات و مشکلات ما بوده و هست و می‌تواند مباحث مختلفی به ویژه پیرامون مسائل اجتماعی و امنیتی و سیاسی برای افراد به وجود بیاورد که چالشی در تحصیل افراد نیز ایجاد می‌کند.
بخشی محبی تاکید کرد: به همین دلیل دستورالعملی در سال ۹۵ صادر شد که به پیشنهاد اداره دادگستری جلسه‌ای در اردیبهشت همان سال تشکیل شد و بحث آیین‌نامه نحوه آموزش اتباع خارجی با تاکید رهبر معزز انقلاب بر موضوع آموزش اتباع خارجی تصویب شده و از این تاریخ به بعد تمامی اتباع خارجی که در مشهد و کشور سکونت داشته از این حق بهرمند شدند.
وی بیان کرد: با نگاه به کشور و توجه به موقعیت خاص ایران در محدوده خاورمیانه که حتی در کشورهای مجاور جنگ و مسائل مختلفی پیش آمده خیلی از افراد به کشور ما و به خصوص مشهد مقدس به دلیل وجود بارگاه معنوی امام هشتم مهاجرت کرده و در این شهر زندگی کنند وبر همین اساس یکی از اصولی که باید به خوبی و با توجه ویژه رعایت شود حق تحصیل برای اتباع بیگانه است.

بخشی محبی خاطر نشان کرد: ما در کنوانسیون ۱۹۵۱ نیز بحث اتباع بیگانه را داریم و یکی از حقوقی که باید رعایت شود بحث آموزش و تحصیل است و باید در نظر گرفت وجود این افراد در ایران هرچند ممکن است تبعات مثبتی را در پی داشته باشد اما می‌تواند تبعات منفی را نیز به همراه داشته باشد و اگر این افراد اجازه تحصیل نداشته باشند به نظر می‌رسد تبعات منفی حضور این افراد پیشی می‌گیرد و می‌تواند به یک معضل بزرگ امنیتی تبدیل شود.

وی ادامه داد: به همین دلیل ما طی مکاتبه‌ای با فرمانداری مشهد و با تاکید بر حق تحصیل اشخاص که در قوانین نیز به این موضوع توجه شده و در قانون اساسی نیز به این مورد به صورت ویژه پرداخته شده و از این سازمان درخواست شد ضمن نظارت جدی بر ثبت نام حس عدم تعلق را از بین برده تا کودکان مشهدی بتوانند بهتر و راحت‌تر به تحصیل مشغول شده تا به یک بحران اجتماعی مبدل نشوند.
بخشی محبی تصریح کرد: و ضمن مکاتبه با فرمانداری مشهد و اشاره به کنوانسیون ۱۸۵۱ و نیز اشاره به قانون اساسی و آیین‌نامه ویژه نحوه آموزش اتباع خارجی امیدداریم که فرمانداری با تدابیر خوبی که تاکنون در این زمینه داشته نسبت به این موضوع و معضلی که در ابتدای مهرماه خانواده و مدارس با ان مواجه هستند به یک دستورالعمل و مصوبه خوب و مفید برسند.
وی افزود: آموزش و پرورش یک ساختار قوه مجریه‌ای بوده و در آن تنها به سیاست‌های خاص خود نگاه می‌کنند و به سیاست‌های کلانی که به دیگر دستگاه‌ها مرتبط است ممکن لست کمتر مورد توجه این دستگاه قرار می‌گیرد و هم می‌توان به این ارگان حق داد زیرا که هر اداره‌ای در چارچوب قوانین و ضوابط خود حرکت می‌کند.
