تقویت و رشد بنگاه های تولیدی داخلی از طریق بازاریابی شبکه ای
صنفی شدن فعالیت بازاریابی شبکه ای چه مزیت هایی نسبت به فعالیت های گذشته این سیستم فروش در کشور دارد؟
قبل از اینکه بگوییم چه مزیت هایی نسبت به گذشته دارد، باید توجه داشته باشیم صدور مجوز برای هر فعالیت اقتصادی باید دارای منشاء قانونی باشد. فعالیتی که در شرکت های بازاریابی شبکه ای انجام می شود از زمره فعالیت مشمول قانون نظام صنفی است. بنابراین ساماندهی این فعالیت ها نیز می بایست در یک چارچوب قانونی دنبال شود.
اگر نهادی مجوز صادر کند، نظارت را نیز باید انجام دهد. نظارت چارچوب و رسیدگی خاص خودش را دارد. وقتی با یک شرکت برخورد می شود، حق شکایت و اعتراض برای آنها محفوظ بوده ، لذا مرجع مذکور باید قادر باشد از تصمیم خودش دفاع کند. به عبارت دیگر در وهله اول باید مقام مجاز برای برخورد بوده و اگر شرکتی را تعلیق یا مجوزش را ابطال می کند، این اقدام باید دارای مبنای قانونی باشد.
پس یک بخش از جواب شما را می توانم بگویم ساماندهی فعالیت مذکور در چارچوب قانونی یک ضرورت است و باید به آن توجه نمود.
حال این آیین نامه چه مزیت هایی دارد؟
طبعاً یکی از مزیت ها ضمن اینکه فعالیت شرکت های مذکور به صورت قانونمند انجام می شود، بستر نظارت نیز به صورت قانونی مهیا می باشد.
ظرفیتی که این آیین نامه دارد هم از نظر حقوق اشخاص یعنی افرادی که می خواهند در این زمینه فعالیت کنند و هم از نظر قانونی یعنی حقوق دولت بسترهای لازم را فراهم نموده است. حقوق مصرف کننده، مرجع رسیدگی به شکایات و نحوه ساماندهی این شرکت ها همگی در آیین نامه مورد نظر لحاظ شده است.
به نظر شما چه الزاماتی باعث قرار گرفتن فعالیت بازاریابی شبکه ای در رسته کسب و کارهای فضای مجازی(فروشگاه های اینترنتی) شده است؟
مجموعه فعالیت هایی که در بازاریابی شبکه ای اتفاق می افتد، دقیقاً منطبق با ماده2 قانون نظام صنفی است یعنی فعالیت بازاریابی شبکه ای یک فعالیت صنفی است. بنابراین باید بازاریابی شبکه ای در قالب نظام صنفی ساماندهی شود.
با توجه به اینکه فعالیت هایی که شرکت های بازاریابی در سراسر دنیا انجام می دهند، با استفاده از بستر اینترنت و ارتباط ( بین بازاریابان ، مصرف کننده و شرکت)از طریق وب سایت شرکت بوده و لذا این موضوع باعث شده ، وجه مشترک با کسب و کارهای اینترنتی ایجاد گردد. همچنین دستگاه های ناظر بر فعالیت بازاریابی شبکه ای همان دستگاه های نظارت کننده بر فروشگاه های اینترنتی می باشند.
آیا اقداماتی جهت قانونی شدن این سیستم فروش در قالب ارائه طرح و لایحه قانونی به مجلس شورای اسلامی انجام گرفته است؟
شاید منظورتان از عبارت قانونی شدن تطبیق بیشتر فعالیت این شرکت ها در بستر قانون می باشد. چون در حال حاضر این فعالیت طبق ماده 87 قانون نظام صنفی صورت می پذیرد. البته ما تازه از بحث آیین نامه فارغ شدیم.
حدود یک سال در جلسات متعدد با دستگاه های مرتبط با موضوع بازاریابی شبکه ای، این آیین نامه را تدوین نمودیم. البته خمیرمایه آیین نامه، همان دستورالعمل قبلی است.
این آیین نامه اخیراً ابلاغ شده و جلسات کمیته نظارت نیز در حال تشکیل شدن است. اصولاً باید مدتی این آیین نامه به مرحله اجرا درآید تا بتوانیم باز خورد آن را دریافت کنیم. ولی فکر نمی کنم در حال حاضر نسبت به گذشته در نقطه عقب تری باشیم. قطعاً در این آئین نامه شرایط برای رعایت حقوق مصرف کنندگان و متقاضیان که بخواهند در این حوزه فعالیت نمایند مساعدتر شده است. همچنین نحوه نظارت نسبت به گذشته نیز شرایط بهتری دارد.
آیا کیفیت محصولات را نیز سازمان حمایت مصرف کنندگان و تولید کنندگان باید بررسی کند؟
هرچند مسوولیت نظارت بر نحوه عرضه کالا و خدمات از جمله گرانفروشی به موجب قوانین و مقررات در حیطه وظایف این کمیته نمی باشد. لکن در حد بضاعت و وظیفه ای که در آیین نامه به عهده دبیرخانه کمیته گذاشته شده است این موضوع را پیگیری می کنیم. بطور مثال کالاها باید دارای مشخصات کامل و مجوزهای لازم شامل مجوز تولید ،پروانه واردات ، بهداشت و… باشد. و اگر تابع استانداردهای خاصی بوده باید استانداردهای لازم نیز از سوی شرکت به دبیرخانه کمیته ارائه شود. در مورد محصول بهداشتی و آرایشی حتماً پروانه بهداشتی اخذ خواهد شد و قیمت نیز بر روی کالاها باید درج شده باشد. به این ترتیب چارچوبی فراهم می شود تا امکان نظارت بهتر سایر مراجع ذی صلاح وجود داشته باشد. با این وجود اگر شرکتی در شعب تعزیرات نیز محکوم شود کمیته نظارت هم طبق مقررات آیین نامه برخورد لازم با شرکت را بعمل خواهد آورد. پس بنابراین در حد بضاعت خودمان سعی کردیم در چارچوب مقررات بستر مناسب برای نظارت موثر و قانونی مهیا نمایم، تا دستگاه های متولی بتوانند نظارت بهتری داشته باشند و حقوق مصرف کننده نیز رعایت گردد.
البته این را هم مد نظر داشته باشید، مجموعه کالاهایی که به موجب این آیین نامه در سیستم بازاریابی شبکه ای عرضه می شود کالاهای پرمصرف است. شما با یک ساعتی با قیمت2 میلیون تومانی مواجه نیستید. با کالا پرمصرف مواجه اید که در سبد مصرف قشر وسیعی از جامعه قرار داشته و یا حداقل چهار بار در سال توسط مصرف کنندگان تجدید خرید می شود. بدیهی است اگر شرکتی گران فروشی داشته باشد مصرف کننده نباید کالای آن شرکت را خریداری نماید. این امر باعث می شود که آن شرکت در مواجه با فروش کم، قیمت کالا را اصلاح کند. همچنین مصرف کننده نیز در صورت مواجه با گران فروشی می تواند شکایت خود را از طریق دبیرخانه کمیته و یا راساً با طرح در مراجع ذی صلاح پیگیری نماید. به غیر از این موارد در آیین نامه، مقرراتی تحت عنوان حق باز پس گیری کالا برای حمایت از بازاریاب لحاظ شده است.
البته مقررات بازپس گیری کالا در فرایند بازاریابی شبکه ای در کل دنیا مرسوم است. برخی از شرکت ها ی بازاریابی شبکه ای به مدت زمان بازپس گیری کالا در آیین نامه اعتراض داشتند ولی به لحاظ اهمیت و حیاتی بودن این موضوع به شرکت ها اعلام شد باید اجناس با کیفیت خوب عرضه نمایند که اگر بازاریاب قادر به بازاریابی محصول و یا مصرف آن نباشد شرکت موظف است تمامی محصولات مرجوعی خریداری شده در 12 ماه گذشته را که قابل فروش مجدد است به شرح بند(ط) ماده 9 آیین نامه از بازاریاب بازپس گیرد. این قاعده هم باعث حمایت از حقوق مصرف کننده خواهد شد و هم باعث دقت نظر بیشتر شرکت بازاریابی خواهد شد.
آیا به دورنمای بازاریابی شبکه ای در ایران خوش بین هستید؟
خوب ما در این حوزه نقاط ضعف و قوتی داریم که به آن پرداختیم. امیدواریم صنعت بازاریابی شبکه ای را به سمتی سوق بدهیم که به عنوان جایگزین مناسب برای شیوه فروش سنتی باعث تقویت هرچه بیشتر رشد بنگاه های تولیدی داخلی و موضوع اشتغال در کشور باشد. امیدواریم که بتوانیم عملاً در آینده بر اساس آیین نامه با نظارتی که اعمال می کنیم و شیوه هایی که برای صدور مجوز داریم به وضعیتی برسیم که طرف حساب ما بنگاه های تولیدی داخلی باشند که از طریق این روش فروش می خواهند با حذف واسطه ها کالاهای خودشان را عرضه کنند نه لزوماً شرکت هایی که به صورت واسط کالا را وارد کرده و عرضه می کنند.
چه مقدار به این نقطه نزدیک شدیم؟
الان نمی توانم دقیق بگویم که ما به دنبال وضعیت ایده ال هستیم و در آیین نامه نیز این موضوع لحاظ شده یعنی یکی از شرایط صدور پروانه کسب داشتن مجوز تولید ویا قرارداد نمایندگی تولید کننده است و به این ترتیب امیدواریم که بتوانیم به این نقطه نزدیک تر شویم.
