پاسخ: با سلام. طبق قانون چنانچه طلاق به درخواست زن نباشد و یا تقاضای طلاق به درخواست مرد ناشی از تخلف زن از وظایف همسری یا سوء اخلاق و رفتار وی نباشد، و این امر برای دادگاه ثابت شود به ترتیب زیر عمل میشود.
الف: چنانچه زن کارهایی که شرعا به عهده وی نبوده را به دستور و درخواست مرد بدون قصد تبرع (بدون قصد قربت و رضا) انجام داده باشد، دادگاه اجرت المثل کارهای انجام شده را محاسبه و به زن پرداخت می کند.
ب: در غیر این صورت با توجه به سنوات زندگی مشترک و نوع کارهایی که زن در خانه شوهر انجام داده و نیز با توجه به وسع مالی مرد، دادگاه مبلغی را از باب بخشش یا همان نحله برای زن تعیین میکند.

پاسخ: زنانی که مورد تجاوز واقع می شوند، باید حداکثر ظرف 72 ساعت جهت اعلام شکایت به پزشکی قانونی مراجعه کنند و لازم است مدارک و اسنادی که نشان دهنده صحت ادعای آنان است به همراه داشته باشند. اما اغلب زنان به دلیل ناآگاهی و عدم شناخت درست یا به این مرکز قضایی مراجعه نمیکنند و یا دیرتر از موعد مقرر و بدون مدرک در پزشک قانونی حاضر میشوند.
هر نوع عمل جنسی که بدون رضایت قربانی انجام شود، تجاوز جنسی نامیده می شود. البته زن باید عاقل و بالغ و بالای 18 سال باشد تا رضایتش برای عمل جنسی شرط باشد. برای کودکان رضایت شرط نیست و هرگونه تماس جنسی با کودکان تجاوز به حساب میآید. همینطور آزار جنسی فردی که قدرت رضایت دادن نداشته باشد نیز تجاوز به حساب میآید.
زنانی که مورد تجاوز جنسی قرار می گیرند اگر به مراکز قضایی و پزشکی قانونی مراجعه کنند، مورد معاینات لازم قرار می گیرند و نمونه های لازم برای بررسی آزمایشگاهی نیز اخذ می شود. وسائل آنان مانند لباس یا دستمالی که به ترشحات مرد آلوده شده است، در آزمایش فرستاده می شود.
