دستگاه های اجرایی در چاپ آگهی های دولتی قانونمند باشند
مدیرعامل خانه مطبوعات و رسانه های کشور گفت: برخی دستگاه های اجرایی بی اعتنا و یا نا آشنا به قانون، عمدا و یا سهوا مرتکب تخلفی اداری شده اند، که باید اشتباه و تخلف خود را متوقف کنند.
مازیار هوشمند با اشاره به رای قطعی صادره از دیوان عدالت اداری در آبان ماه سال جاری در خصوص چاپ آگهی های دولتی با مجوز وزارت فرهنگ و ارشاد اسلامی، افزود: برخی دستگاه های اجرایی بی اعتنا و یا بدون توجه به قوانین و دستورالعمل های موجود در خصوص نحوه انتشار آگهی های خود، آگهی های خود را بدون مجوز (م.الف) ادارات فرهنگ و ارشاد اسلامی منتشر می نمایند، که این موضوع یک تخلف اداری محسوب میشود.
وی افزود: با توجه به رای قطعی دیوان عدالت اداری در آبان ماه سال جاری، نامه وزیر محترم فرهنگ و ارشاد اسلامی به وزیر محترم کشور و درخواست ورود استانداران به جلوگیری از این تخلفات، چاپ آگهی های دستگاه های اجرایی از مجرایی جز وزارت فرهنگ و ارشاد اسلامی، و با هر نوع مجوز دیگر به جز مجوز ارشاد، یک تخلف آشکار، و قابل پیگیری و برخورد است.
سخنگوی خانه مطبوعات و رسانه های کشور افزود: توزیع آگهی های دولتی از سوی وزارت فرهنگ و ارشاد اسلامی یک وظیفه قانونی است که دستگاه های اجرایی مکلف به اجرای آن هستند، و علاوه بر وزارت فرهنگ و ارشاد اسلامی، استانداران نیز موظف شده اند با تخلفات احتمالی دستگاه های اجرایی در چاپ آگهی های خود، برخورد کرده، و آنان را به مراکز نظارتی و بازرسی معرفی نمایند.
هوشمند با اشاره به دستورالعمل جدید توزیع آگهی های دولتی برای سال ۹۸ که به زودی منتشر و ابلاغ خواهد شد، خاطرنشان کرد: محدودیت هایی از جمله عدم پرداخت یارانه و عدم تخصیص آگهی های دولتی برای رسانه های مکتوبی که آگهی های دستگاه های اجرایی را بدون مجوز ارشاد و بر خلاف آئین نامه منتشر می کنند، پیش بینی شده است.
مدیرعامل خانه مطبوعات و رسانه های کشور در پاسخ به این سوال که آیا شهرداری ها و وزارت نفت نیز مشمول این دستورالعمل هستند یا خیر، گفت: کلیه وزارتخانه ها، موسسات دولتی، موسسات یا نهادهای عمومی غیر دولتی، نهادهای انقلابی، شهرداری ها، دهیاری ها، شرکت های دولتی و کلیه دستگاه هایی که شمول قانون بر آنها مستلزم ذکر و یا تصریح نام است، مانند شرکت ملی نفت ایران، سازمان گسترش و نوسازی صنایع ایران، بانک مرکزی، بانک ها و بیمه های دولتی، مکلف هستند آگهی های خود را صرفا از طریق وزارت فرهنگ و ارشاد اسلامی سفارش و منتشر نمایند.

وی افزود: وزارت نفت به واسطه برداشتی نادرست از قوانین داخلی خود، و به دلایلی از جمله اهمیت چاپ و انتشار آگهی های مراکز و شرکت های وابسته در نشریاتی که از تیراژ و گستره توزیع بیشتری برخوردارند، از سال ۹۳ اقدام به ایجاد اداره ای به نام اداره تمرکز، پایش و توزیع آگهی های صنعت نفت نمود، و آگهی های خود را مستقیما و بدون مجوز ارشاد به رسانه ها برای چاپ ارسال می نماید، که قطعا با صدور رای دیوان عدالت اداری، این وزارتخانه نیز آگهی های خود را از کانال وزارت فرهنگ و ارشاد اسلامی توزیع و منتشر خواهد کرد.
مازیار هوشمند افزود: البته در دستورالعمل جدید توزیع اگهی های دولتی برای سال ۹۸ اهداف و انتظارات مورد نظر دستگاه هایی مثل وزارت نفت از چاپ آگهی های آن مجموعه نیز پیش بینی شده است، که امید است از سال جدید همه دستگاه ها، با اجرای دقیق این قانون، به تکلیف اداری خود توجه بیشتری نمایند.

سخنگوی خانه مطبوعات و رسانه های کشور در پاسخ به این سوال که چه تدابیری برای مقابله با مقاومت برخی دستگاه های اجرایی در برابر اجرای این قانون و دستورالعمل از سوی وزارت فرهنگ و ارشاد اسلامی اندیشیده شده است، تاکید کرد: از آذر ماه و با تفویض ۱۶ اختیار از وظایف ادارات کل فرهنگ و ارشاد اسلامی در حوزه رسانه ها به خانه های مطبوعات و رسانه ها، رصد تخلف دستگاه های اجرایی در انتشار آگهی های خود، علاوه بر ادارات فرهنگ و ارشاد اسلامی، از سوی وزارت ارشاد به خانه های مطبوعات و رسانه های کشور محول شده است، که قطعا این تشکل در راستای قانونمندی و برخورداری عادلانه رسانه ها از توزیع آگهی های دولتی، در ارجاع تخلف مراکز دولتی و سایر مراکز دیگر به مراجع نظارتی و بازرسی، ذرهای کوتاه نخواهد آمد.
مدیرعامل خانه مطبوعات کشور قانونمندی و اجرای دقیق قانون را از خواسته های مهم ریاست محترم جمهور از مسئولین دولت برشمرد، و افزود: بعید است وزارتخانه و دستگاهی در دولت تدبیر و امید، بر خلاف قانون و در تقابل با خواسته موکد رئیس جمهور، قانون گریزی و تکرار تخلف را دنبال نماید.
وی از مدیران این تشکل ها در استان ها خواست با دقت و تمرکز بر این مهم، تخلفات دستگاه های اجرایی را در انتشار اگهی های دولتی رصد و گزارش نمایند، و افزود: با لازم الاجرا بودن رای دیوان عدالت اداری، و همچنین اجرای دقیق دستورالعمل توزیع آگهی های دولتی، انشاءالله هم از تخلفات احتمالی دستگاه های مشمول این قانون کاسته شود، و هم در راستای حمایت از رسانه ها عادلانه تصمیم گیری شود.
