غیبت نا موجه رئیس جمهور
حدود یک ماه تا پایان مهلت چهار ماهه FATF به ایران باقیمانده است، در این سه ماه اخیر دولت و مجلس تلاش فراوانی برای تصویب لوایح چهارگانه صورت دادند، اما این لوایح به سد شورای نگهبان برخوردند. سه مورد از لوایح با ایرادات شورای نگهبان به مجلس بازگشت و با پافشاری مجلس به مجمع تشخیص مصلحت نظام ارجاع شد، چند روز پیش بالاخره مجمع تشخیص مصلحت نظام به ریاست آیتالله آملی لاریجانی مصوبه مجلس در اصلاح قانون مبارزه با پولشویی را البته با تغییراتی تصویب کرد. پیشتر نیز شورای نگهبان لایحه “اصلاح قانون داخلی مبارزه با تامین مالی تروریسم” را تصویب کرده بود. اما حالا تمام دعوا بر سر دولایحه است. لوایحی که ابتدا با چالش فراوانی روبه رو شدند. لایحه اول لایحه پیوستن ایران به کنوانسیون پالرمو است. این کنوانسیون برای مبارزه با جرائم سازمان یافته فراملی است. لایحه دوم، پیوستن ایران به ” کنوانسیون بین المللی مقابله با تامین مالی تروریسم” یا همان “CFT” است.
این دو لایحه این روزها در کانون جدال موافقان و مخالفان پیوستن ایران به FATF هستند. سه ماه پیش گروه ویژه اقدام مالی علیه پولشویی و تامین مالی تروریسم (FATF) اعلام کرد به ایران چهار ماه فرصت میدهد تا تعهداتش برای مبارزه با پولشویی را عملی کند. حالا زمان زیادی برای ایران باقی نمانده و هنوز تکلیف دو لایحه مهم مشخص نشده است. روز شنبه دومین جلسه مجمع به ریاست آملی لاریجانی برگزار شد و علی لاریجانی رئیس مجلس، محمدجواد ظریف وزیر خارجه و لعیا جنیدی معاون حقوقی رئیسجمهور هم در این جلسه حاضر شده بودند تا شاید بالاخره بتوان برای پالرمو کاری کرد. اما درنهایت پس از طرح دیدگاههای مختلف پیرامون لایحه مذکور، از سوی اعضای مجمع و همچنین اظهار نظر نمایندگان مجلس شورای اسلامی و دولت، ادامه بررسیها به کمیسیونهای سیاسی، دفاعی و حقوق قضایی محول شد تا نتایج آن در جلسه آتی مجمع مطرح شود و مورد بررسی قرار گیرد. احمد توکلی، عضو مجمع تشخیص مصلحت نظام هم کمی پس از اتمام این جلسه خبر داد که قرار است تا شنبه آینده بررسی پالرمو در مجمع تشخیص مصلحت نظام به اتمام برسد. او گفت: «برای بررسی پالرمو جلسه فوقالعادهای در روز چهارشنبه تشکیل خواهد شد و قرار شده تا شنبه هفته آینده بررسی این موضوع به اتمام برسد.»
حجتالاسلام غلامرضا مصباحی مقدم، عضو مجمع تشخیص مصلحت نظام هم با اشاره به تشکیل نشست مجمع تشخیص مصلحت نظام گفت: “لایحه الحاق جمهوری اسلامی ایران به کنوانسیون مبارزه با جرائم سازمان یافته فراملی که مورد اختلاف میان مجلس شورای اسلامی و شورای نگهبان بود، مطرح شد و مورد بحث قرار گرفت.”
او ادامه داد: “درباره کلیات لایحه بحثهای مفصلی میان موافقان و مخالفان صورت گرفت اما، چون گزارشهای کمیسیونهای تخصصی آماده نبود مقرر شد پس از تکمیل و ارائه این گزارشها، لایحه الحاق به کنوانسیون پالرمو در نشستهای بعدی مجمع مورد بررسی قرار گیرد.”
اما این تمام موضوع نیست، ماههای اخیر حوزه اختیارات مجمع تشخیص مصلحت در اصلاح این لوایح نیز جای بحث و اختلاف نظر زیادی بوده است. در ماههای اخیر هیاتی در مجمع تشکیل شده که مصوبات مجلس را با مصوبات مجمع تطبیق میدهد و در صورت مغایریت، از قانونی شدن مصوبات مجلس جلوگیری میکند. منتقدان میگویند که این هیات موازی با شورای نگهبان فعالیت میکند و حتی وارد حیطه قانونگذاری شده است.
روز شنبه حشمت الله فلاحت پیشه، رئیس کمیسیون امنیت ملی و سیاست خارجی مجلس گفت که مجمع تشخیص مصلحت نظام نباید وارد اصلاح لایحه الحاق ایران به کنوانسیون جرایم سازمان یافته فراملی یا لایحه پالرمو شود.
فلاحت پیشه افزود: “مجمع تشخیص باید نظر رد یا تایید خود نسبت به لایحه پالرمو را ارائه کرده و وارد فضای اصلاحی نشود، چون این به معنای کاستن از حدود و اختیارات قوه قانون گذاری در کشور است.”
رئیس کمیسون امنیت ملی مجلس گفت: «مجلس به وظیفه قانون گذاری خود عمل کرد و شورای نگهبان نیز وظیفه شرعی و قانونیاش را در بررسی مصوبه مجلس انجام داد. با توجه به اختلاف نظر بین مجلس و شورای نگهبان این لایحه به مجمع تشخیص برای ارائه نظر مصلحتی درباره تایید یا رد نظرات مجلس رفت.»
همزمان با بررسی لایحه پالرمو در مجمع تشخیص، برخی چهرههای مذهبی همچون آیت الله نوری همدانی این لایحه را مغایر با استقلال کشور دانستند و با آن مخالفت کردند. رسانههای اصولگرا نیز فشار سنگینی در ماههای اخیر در این رابطه به نهادهای تصمیم گیرنده وارد آورده اند. حالا آنها می گویند برای بررسی لوایج نباید عجله کرد و مجمع با دقت آنها را بررسی کند. این در حالی است که دولت می گوید زمان زیادی ندارد.
مسئله دیگر تصویب پیوستن ایران به “CFT” است، لایحه ای که چند ماه پیش از سوی مجلس تایید شد، اما با ایرادات فراوان شورای نگهبان روبه رو گردید. شورای نگهبان میگوید این لایحه قابل اصلاح نیست. مجلس نیز لایحه را به مجمع تشخیص ارسال کرد. در حالیکه مجمع متمرکز بر لایحه پالرمو است، دولت به دنبال آن است که تا پایان مهلت FATF تکلیف لایحه “CFT” هم روشن شود. در همین راستا گفته میشود تعدادی از وزرا در نامهای به رهبر معظم انقلاب خواستار آن شده اند که مجمع با سرعت بیشتری لوایح “پالرمو” و “CFT” را بررسی کند. با این حال ظاهرا برخی محافل این نامه را “تهدید به استعفا” تفسیر کرده اند.
غیبت روحانی در روزهای حساس
در حالی که مجمع تشخیص مصلحت نظام این روزها با رئیس جدیدش درگیر تصویب لوایح بسیار حساس و حیاتی مربوط FATF هستند، اما رئیس جمهور از حضور در جلسات مجمع خودداری میکند. هنوز مشخص نیست که چرا روحانی با وجود اینکه میداند تصویب این لوایح اهمیت فوق العادهای برای کشور دارد در جلسات مجمع تشخیص غیبت میکند و فرصت طلایی دفاع از لوایح دولت را نادیده میگیرد. حسن روحانی در زمان ریاست آیت الله هاشمی رفسنجانی نیز در بسیاری از جلسات مجمع شرکت نمیکرد. در آن زمان گفته میشد به دلیل کمبود وقت و اینکه اشتغال به مسائل مهمتری دارد به مجمع نمیرود. از طرف دیگر گفته میشد خود آیت الله هاشمی همفکر و مدافع بزرگ دولت در جلسات مجمع است و نیازی به حضور روحانی نیست. پس از درگذشت آیت الله هاشمی رفسنجانی، آیت الله هاشمی شاهرودی بر مسند ریاست مجمع نشست، اما این بار نیز این روند ادامه یافت و روحانی غایب بزرگ جلسات مجمع بود. در این باره هم این توجیه وجود داشت که جلسات مجمع به خاطر بیماری آیتالله هاشمی و دوره گذار مدیریتی نظم مناسبی ندارد و تصمیمی گیریهای مهمی هم در جریان نیست و در واقع نیازی به حضور رئیس جمهور نیست. پس از درگذشت آیت الله شاهرودی، رهبر انقلاب به سرعت آیت آلله آملی لاریجانی را به عنوان رئیس مجمع معرفی کردند. آیت الله لاریجانی نیز تا کنون دو جلسه مجمع را برگزار کرده و در این جلسات لوایح حیاتی “FATF” بررسی شده است. به نظر میرسد عدم حضور رئیس جمهور در این جلسات حداقل در مقطع کنونی توجیه مناسبی ندارد. هرچند نمایندگان دولت در جلسات حضور دارند اما روحانی میتوانست خود در جلسات مجمع حاضر شود و محکم از لوایح دولت دفاع کند. لوایحی که دولت معتقد است در صورت عدم تصویب، میتواند برجام را هم کاملا به خطر اندازد. در واقع اگر لوایح آنگونه که باید تصویب نشوند، باید گفت مرگ برجام قطعی میشود. به این ترتیب عدم پیوستن ایران به “FATF” بهانهای برای اروپا ایجاد می کند که به تعهداتشان در قالب برجام عمل نکند. حتی شرکای مهم ایران همچون هند، چین، روسیه و ترکیه نیز در برقراری ارتباطات مالی با ایران با چالش روبه رو خواهند شد. در این بین عدهای دلیل عدم حضور روحانی در جلسات مجمع را با این فرضیه توضیح میدهند که رئیس جمهور تمایل داشته که خود ریاست مجمع را برعهده بگیرد، اتفاقی که رخ نداد و آیت الله آملی لاریجانی در این دوره ریاست مجمع را عهده دار شده است. حتی اگر این فرضیه را هم درست بدانیم، باز هم به نظر میرسد که صلاح دولت و کشور در این بود که رئیس جمهور در جلسات مجمع حاضر شود.
