بررسی نمی کنیم
علی لاریجانی که مدیریتش در مجلس به تصویب لایحه CFT انجامید این بار در نامهای به آیتالله احمد جنتی، دبیر شورای نگهبان گفته مجلس ایرادات اخیر این شورا بر CFT را بررسی نمیکند. این خبر دوشنبه شب گذشته به نقل از حسین میرمحمد صادقی، معاون قوانین مجلس شورای اسلامی منتشر شد که موضع مجلس در برابر اقدام اخیر شورای نگهبان را مشخص میکند. سیزدهم آبان شورای نگهبان CFT را مغایر موازین شرع اعلام کرد. یکشنبه سیزدهم آبان عباسعلی کدخدایی سخنگوی شورای نگهبان در توئیتر گفت: شورای نگهبان لایحه الحاق دولت جمهوری اسلامی ایران به کنوانسیون مبارزه با تامین مالی تروریسم (CFT) را در جلسات متعدد خود مورد بررسی قرار داد و واجد ایرادات و ابهاماتی دانست. این نظر شامل موارد خلاف شرع، خلاف قانون اساسی و ابهام، در موعد مقرر برای مجلس شورای اسلامی ارسال شده است. پیش از اعلام این خبر، برخی رسانهها اعلام کرده بودند مهلت شورای نگهبان برای بررسی مصوبه مجلس به پایان رسیده است؛ موضوعی که در صحن مجلس نیز مطرح شد. محمود صادقی، نماینده تهران در مجلس در تذکری شفاهی در خصوص عدم اطلاع نمایندگان از زمان ارسال نظر شورای نگهبان درباره CFT به مجلس گفت: اخباری مبنی بر موضع شورای نگهبان در مورد CFT مطرح شده و این در حالی است که هنوز به دست ما نرسیده است. سخنگوی شورای نگهبان در توئیت به این نکته اشاره کرده که نظر این شورا به مجلس فرستاده شده است، آیا این اقدام در موعد مقرر صورت گرفته است؟ علی لاریجانی نیز در پاسخ به این تذکر گفت: شورای نگهبان نظر خود را به مجلس ارسال کرده و من هم طبق روال همچون سایر موارد آن را برای کمیسیون و معاونت قوانین ارسال کردم. ضمن اینکه این اقدام در موعد مقرر صورت گرفته و شورای نگهبان 2 تا 10 روز را رعایت کرده است.
لاریجانی به جنتی: ایرادات شورای نگهبان را بررسی نمیکنیم
دوشنبه شب گذشته حسین میرمحمد صادقی، معاون قوانین مجلس شورای اسلامی از نامه علی لاریجانی به آیت الله جنتی خبر داد و گفت: خانه ملت ایرادات شورای نگهبان را بررسی نمیکند. او افزود: 15 مهرماه CFT تصویب شد و در تاریخ 16 مهرماه به شورای نگهبان ارسال شد. وی بیان کرد: شورای نگهبان تا 6 آبان ماه عملا فرصت داشت در مورد این لایحه اظهار نظر کند. میرمحمد صادقی تصریح کرد: آنان در فرصت قانونی که همان 6 آبان ماه بود ایرادات خود را در 23 مورد به مجلس ارسال کردند که این ایرادات به کمیسیون امنیت ملی ارجاع شد و پس از بررسی در این کمیسیون در مجلس شورای اسلامی بررسی میشود. معاون قوانین مجلس شورای اسلامی اضافه کرد: از طرف دیگر 13 آبان ماه نامه دیگری از سوی کدخدایی سخنگوی شورای نگهبان به دست ما رسید که در آن ایرادات مجمع تشخیص مصلحت در راستای بند 2 ماده 110 قانون اساسی بیان شده بود. شورای نگهبان ضمن وارد دانستن اشکالات متعدد به مصوبه پیوستن ایران به لایحه CFT را از اساس رد میکند و مینویسد: “با توجه به ایرادات و اشکالات متعدد مذکور با عنایت به اینکه الحاق به این کنوانسیون، با فرض غیرقابل اصلاح بودن اشکالات وارد بر آن، خلاف منافع و امنیت ملی کشور جمهوری اسلامی ایران است، مغایر موازین شرع شناخته شد. ”
محسن رضایی دبیر مجمع تشخیص مصلحت نظام در این باره گفته: اگر مجلس ایرادات شورای نگهبان را نپذیرفت، این لایحه به مجمع تشخیص مصلحت ارجاع و مورد بررسی قرار خواهد گرفت. او درباره وظیفه هیات عالی نظارت مجمع تشخیص مصلحت نظام در ارتباط با این لایحه گفته: وظیفه هیات نظارت مجمع تشخیص مصلحت نظام این است که کلیات مصوبات دولت، مجلس و قوه قضاییه را در چارچوب سیاست های مطرح شده بررسی کرده و این مغایرتها اصلاح شود.
شورای نگهبان باید پاسخ گو باشد
بهروز نعمتی، سخنگوی هیات رئیسه مجلس در ارتباط با بررسی ایرادات شورای نگهبان در مجلس توضیح داده است: چه اشکالی داشت شورای نگهبان و سخنگوی این شورا نظر خود درباره CFT را در همان زمان یعنی ششم آبان به صورت رسمی اعلام میکرد؟ باید اعضا شورای نگهبان پاسخگو باشند که چرا این اقدام را انجام ندادهاند. سخنگوی هیات رئیسه مجلس شورای اسلامی در مورد نوع ایرادات شورای نگهبان به کنوانسیون CFT گفت: آنچه من از ایرادات شورای نگهبان به لایحه الحاق دولت جمهوری اسلامی ایران به کنوانسیون مقابله با تامین مالی تروریسم دیدهام، این است که بخشی از این ایرادات به راحتی قابل برطرف شدن است، ولی بعضی از آنها موارد خاصی است که به نظرم با جلساتی با اعضا شورای نگهبان میتواند برطرف شود. نعمتی خاطرنشان کرد: کمیسیون امنیت ملی و سیاست خارجی مجلس قطعا این جلسات را برگزار خواهد کرد و با توجه به حساسیت موضوع ممکن است رئیس مجلس دستور دهد بخشی از این موارد در صحن مورد بررسی نمایندگان، اعضا شورای نگهبان و کارشناسان مربوطه قرار گیرد، ولی به طور کلی دارم که با تعامل بین مجلس و شورای نگهبان این ایرادات بدون ارجاع به مجمع تشخیص مصلحت نظام قابل حل است.
پیوستن ایران به کنوانسیون CFT تایید شده محسوب میشود
از منظر حقوقی باید گفت که مقام معظم رهبری بر اساس بند 2 اصل 110 قانون اساسی (ناظر به بند 1 همین اصل) اختیاراتی دارد که آن را به مجمع تشخیص واگذار کرده؛ بنابراین مجمع میتواند بر حسن اجرای سیاستهای کلی نظام نظارت داشته باشد و این نظارت بررسی لوایح و طرحهای موجود در دولت، مجلس و شورای نگهبان را نیز در بر میگیرد. مجمع میتواند بدون آنکه مرحله جدیدی در فرآیند قانون گذاری ایجاد کند، به مجلس، شورای نگهبان، دولت و هر نهاد و ارگان یا تشکیلات دیگری تذکر دهد؛ بنابراین چنانچه مجمع تشخیص در خصوص لوایح مورادی را به شورای نگهبان اعلام کرده باشد، شورا میتواند این موارد را به عنوان اشکالاتی که خود از نظر شرعی یا رعایت حقوق اساسی یا سیاستهای کلی نظام بر طرح یا لایحه وارد میداند به مجلس اعلام کند. در این صورت مجلس موضوع را به عنوان ایرادات شورای نگهبان و نه چیز دیگر رسیدگی خواهد کرد. مجلس یا بر نظرات خود اصرار میورزد و یا ایرادات شورای نگهبان را مرتفع و قانون را به شورای نگهبان ارسال خواهد کرد. اگر مجلس به نظر خود اصرار کند نیز موضوع به مجمع تشخیص مصلحت نظام ارجاع داده میشود و مجمع به وظیفه قانونی خود به عنوان – مجمع تشخیص مصلحت نظام – عمل خواهد کرد. بحث وصول به موقع شورای نگهبان مقوله دیگری است. چنانچه از تاریخ اعلام مجلس به شورای نگهبان با احتساب روز ابلاغ و اقدام و در نظر گرفتن مهلت 10 روز اضافی بیش از 20 روز گذشته باشد و پاسخ شورای نگهبان پس از این مدت به مجلس ارسال شود مجلس در مورد بررسی ایرادات با تکلیفی مواجه نخواهد بود و قانون تایید شده محسوب میشود.
پیوستن ایران به FATF اجتناب ناپذیر است
با وجود آنکه مجلس میگوید تنها ابهامات اولیه شورای نگهبان را بررسی میکند، اما چقدر احتمال دارد شورای نگهبان زیر بار این موضوع نرود و از اساس در برابر کلیت لایحه بایستد؟ شواهد نشان می دهد که سرانجام مجلس پیروز میشود. مجلس برای تصویب لایحه CFT از سوی رهبری آزادی عمل داشت. علی لاریجانی نیز این را اعلام کرده است. حالا که شورای نگهبان به مصوبه CFT ایراد گرفته و لاریجانی آن را خارج از موعد عنوان کرده، رئیس مجلس به خاطر پشتوانهای که از رهبری دارد میتواند پیروز شود. شورای نگهبان با علم به آنکه مجلس در این زمینه دستش باز است، به CFT ایراد گرفت. در کشور جوی حاکم شده بود که عدهای با این لایحه به صورت جدی مخالفت میکردند. شورای نگهبان هم سعی کرد در اشکالاتی که وارد میداند بدون اغماض برخورد کند. مطمئنا قانون مقابله ایران با تامین مالی تروریسم به خاطر اراده ملی که پشت آن قرار دارد در مهلت قانونی که برای کشور تعیین شده به اجرا درخواهد آمد و اجرای آن از این مهلت قانونی فراتر نخواهد رفت.
