«رجل سیاسی» کیست؟

نماینده مردم قوچان و فاروج در مجلس شورای اسلامی دلیل عدم موافقت شورای نگهبان با طرح مجلس نهم برای تفسیر رجل سیاسی را تشریح کرد.

هادی شوشتری در رابطه با لزوم اصلاح قانون انتخابات ریاست جمهوری افزود: یکی از مطالبات فرهیختگان، سیاسیون و جامعه این است که تکلیف قانون انتخابات ریاست جمهوری مشخص شود، در مجلس نهم طرحی تهیه شد تا حداقل مفاهیم کلی رجل سیاسی، مدیر و مدبر بودن را مشخص کند.

نماینده مردم قوچان در مجلس شورای اسلامی بیان کرد: شورای نگهبان در آن زمان معتقد بود که اگر قانون اساسی از منظر حقوقی مورد بررسی قرار گیرد، اصل ۱۱۵ قانون اساسی که گفته رئیس جمهور باید از میان رجال مذهبی سیاسی، ایرانی‌الاصل، مدیر و مدبر انتخاب شود، یک حکم کلی را به شکل  مطلق تاسیس کرده ولی تفصیل آن را به قانون عادی ارجاع نداده است.

عضو کمیسیون امنیت ملی و سیاست خارجی مجلس شورای اسلامی افزود: این در حالی است که در ارتباط با انتخابات مجلس شورای اسلامی و شوراها مقننِ قانون اساسی، یک اصل کلی را تاسیس کرده و تعیین جزئیات را به قانون عادی احاله داده و شرایط انتخاب شوندگان و انتخاب کنندگان این انتخابات را بیان کرده است.

شوشتری متذکر شد: به لحاظ فنی و تخصصی برخی معتقد هستند که قانون اساسی در ارتباط با انتخاب ریاست جمهوری به طور مطلق گفته رجل سیاسی، مذهبی، مدیر و مدبر و ایرانی الاصل باشد و در اصول بعدی قانون اساسی تعیین مصادیق این شرایط را بر عهده شورای نگهبان قرار داده است؛ این موضوع سبب شد تا شورای نگهبان طرحی که در مجلس نهم تهیه شد را نپذیرد.

عضو کمیسیون امنیت ملی و سیاست خارجی مجلس شورای اسلامی با بیان اینکه اگر قرار باشد همه بتوانند در انتخابات ریاست جمهوری ثبت نام کنند سبب وهن کشور می‌شود، گفت: باید علاوه بر اینکه معیارها مشخص شود، به سمت انتخابات حزبی برویم تا در درون احزاب و جریانات عمده کشور رقابت‌ها انجام شود و در نهایت رقابت بین دو گزینه اصلی دو جریان سیاسی کشور برگزار شود.
