در خصوص این موضوع با مسئول یکی از سایت های بانک مشاغل به گفتگو پرداختم وی معتقد بود این کار قانونی است و نیاز به مجوز ندارد. وی درخصوص نحوه جمع آوری شماره تلفن ها بیان کرد: شماره ها را از داخل روزنامه‌ها ، سایت‌ها و بیلبوردها، جمع آوری می‌کنیم‌.همچنین بانک شماره تلفن پزشکان که دارای ۳۴هزار شماره از پزشکال سراسر کشور است به مبلغ ۳۰هزار تومان به فروش می‌رود.

این فرد وقتی متوجه شد که یک خبرنگار مشغول گفتگو با اوست از ادامه گفتگو امتناع کرد.

برای به دست آوردن اطلاعات بیشتر در خصوص قانونی بودن این کار به سراغ حمید اخوان  وکیل پایه یک دادگستری رفتم، وی گفت: با پیشرفت تکنولوژی و نفوذ گوشی های هوشمند انگیزه تبلیغات در بستر فضای مجازی زیاد شده است، بعضی شرکت های تبلیغاتی با هدف دسترسی مستقیم به مخاطب و تبلیغات هدفمند،  به دنبال شناسایی افراد دارای مشاغل خاص بوده و به دنبال این نیاز، افراد و شرکت‌هایی نیز در جستجوی بانک‌های اطلاعات مشاغل از قبیل اسم و آدرس و تلفن وکلا ، پزشکان ، فرهنگیان و سایر صنوف می باشند.

وی افزود: تلفن زنگ می‌خورد و فردی از آن سو که شغل و فامیل شما را می داند بی درنگ و  بدون مکث در حال معرفی کالا یا خدمتی است که تلاش دارد توجه شما را به آن جلب کند و یا انبوهی از پیامک ها که درباره موضوعات مختلف برای شما ارسال می‌شود و یا تبلیغاتی که در فضاهای مجازی در صفحه شخصی شما ارسال می‌گردد و یا اینکه هر روزه در گروه یا کانال شرکتی عضو می‌شوید، از سرویس خودرو  گرفته تا خدمات مهاجرت که روشی جدید در بازار یابی است.

این اطلاعات چگونه به دست بازاریابان  می رسد؟

حمید اخوان در خصوص نحوه یافتن اطلاعات افراد توسط بازاریاب‌ها تصریح کرد: هر یک از مشاغل بر بستر اتحادیه ، کانون، مرکز و امثال این‌ها فعالیت داشته و بانک اطلاعاتی ایشان در اختیار آن مجموعه بوده و این افراد یا شرکت‌ها از هیچ تلاشی برای دسترسی به آن بانک دریغ نخواهند کرد و سپس بانک اطلاعاتی مذکور را با اخذ مبالغی  در اختیار شرکت‌های تبلیغاتی قرار می‌دهند.

قانون در این باره چه نظری دارد ؟

وی در خصوص ماده 17 قانون جرائم رایانه ای بیان کرد: این ماده می گوید، هر کس به وسیله سامانه های رایانه ای یا مخابراتی صوت یا تصویر یا فیلم خصوصی یا خانوادگی یا اسرار دیگری را بدون رضایت او جز در موارد قانونی منتشر کند یا در دسترس دیگران قرار دهد، به نحوی که منجر به ضرر یا عرفاً موجب هتک حیثیت او شود، به حبس از نود و یک روز تا دو سال یا جزای نقدی از ۵۰۰هزار تومان تا چهار میلیون تومان و یا هر دو مجازات محکوم خواهد شد.

حمید اخوان وکیل پایه یک دادگستری با بیان این سوال که آیا مشخصات و تلفن شغلی افراد جز اسرار خصوصی یا خانوادگی است و افشای آن مشمول قانون فوق می‌شود یا نه، گفت:  بدیهی است که پاسخ  این سوال خیر است پس باید ببینیم در این رابطه چه قوانین دیگری موجود است؛ قوانینی که در این باره وجود دارد به شرح زیر می باشد.

ماده ۶۴ و 65 و 75 قانون تجارت الکترونیک

حمید اخوان در خصوص ماده 64 قانون تجارت الکترونیک خاطر نشان کرد: این قانون می گوید، به منظور حمایت از رقابت‌های مشروع و عادلانه در بستر مبادلات‌الکترونیکی، تحصیل غیرقانونی اسرار تجاری و اقتصادی بنگاه‌ها و مؤسسات برای خود و ‌یا افشای آن برای اشخاص ثالث در محیط الکترونیکی جرم محسوب و مرتکب، به ‌مجازات مقرر در این قانون خواهد رسید.

وی در مورد ماده 65 قانون تجارت الکترونیک تشریح کرد: اسرار تجاری الکترونیکی «‌داده پیام» ی است که شامل اطلاعات، ‌فرمول ها، الگوها، نرم‌افزارها و برنامه‌ها، ابزار و روش‌ها، تکنیک‌ها و فرایندها، تألیفات منتشر‌نشده، روش‌های انجام تجارت و داد و ستد، فنون، نقشه‌ها و فراگردها، اطلاعات مالی، ‌فهرست مشتریان، طرح‌های تجاری و امثال این‌ها است، که به طور مستقل دارای ارزش‌اقتصادی بوده و در دسترس عموم قرار ندارد و تلاش‌های معقولانه‌ای برای حفظ و حراست‌ از آنها انجام شده است.

حمید اخوان در مورد ماده 75 قانون تجارت الکترونیک تبیین کرد: متخلفین از ماده (64) این قانون و هرکس در بستر مبادلات الکترونیکی‌ به منظور رقابت، منفعت و یا ورود خسارت به بنگاه‌های تجاری، صنعتی، اقتصادی و‌خدماتی، با نقض حقوق قراردادهای استخدام مبنی بر عدم افشای اسرار شغلی و یا‌ دستیابی غیرمجاز، اسرار تجاری آنان را برای خود تحصیل نموده و یا برای اشخاص ثالث‌ افشا نماید به حبس از شش ماه تا دو سال و نیم و جزای نقدی معادل ۵میلیون تومان  محکوم خواهد شد.

وکیل پایه یک دادگستری در پایان سخنان خود خاطر نشان کرد:هرچند که به نظر بنده اطلاعات شغلی صنوف نمی‌تواند جز اسرار تجاری محسوب گردد، اما مهمترین چیزی که در این باره می‌توان گفت این است که تبلیغات نابهنگام و همراه با مزاحمت نه تنها صرف هزینه بدون نتیجه است بلکه اثر ضد تبلیغی داشته و نتیجه عکس خواهد داشت.

با بررسی این موضوع به این نتیجه می رسیم که جمع آوری و فروش شماره تلفن افراد به بازاریابان جرم محسوب نمی شود، اما اگر بازاریاب‌های بی تدبیر و بی موقع با افراد تماس بگیرند ممکن است با واکنش‌های منفی آنان مواجه هرچند این عمل می‌تواند از دید بعضی ها مثبت باشد و افرادی باشند که به چنین کالا یا خدماتی نیازمند باشند.
