ورود دادستانی به پروژه کمربندی جنوبی مشهد قابل قبول نیست
رئیس کمیسیون حقوقی شورای اسلامی شهر مشهد گفت: از لحاظ حقوقی قوه قضاییه نمی تواند در صلاحیتهای قوه مجریه مداخله کند لذا اینکه دادستانی مشهد دستور به تغییر کاربری یک پروژه و زمین مانند جاده کمربندی جنوبی بدهد قابل قبول نیست.
سیدمحسن حسینی پویا افزود: این اعتراض را به صورت جدی به دادستانی مشهد داریم که تفکیک صلاحیت را لحاظ نکرده اند.
وی ادامه داد: پروژه کمربندی جنوبی مصوبه طرح جامع دوم شهر مشهد را دارد. سال 1379 نیز کمیسیون ماده پنج مرزهای کمربندی جنوبی را تفکیک کرد، سال 1382 اجرای پروژه آغاز زده و تا سال 1384 قسمتی از پروژه خاکبرداری شد اما از همان سال بنا به دلایلی تا سال 1391 اجرای این پروژه متوقف شد.
عضو شورای شهر مشهد گفت: سال 1391 اجرای پروژه کمربندی جنوبی مشهد دوباره آغاز شد. شورای پنجم شهر مشهد این پروژه را از گذشتگان به ارث برده و تاکنون روند طبیعی خود را طی کرده تا اینکه پارسال بحث مشکلات زیست محیطی برای آن مطرح و اجرایش متوقف شد.
وی افزود: تاکنون هزار و 800 میلیارد ریال برای این پروژه هزینه شده لذا باید در تصمیمات مدیرت شهری صلاح شهر در نظر گرفته شود تا عوارض دریافتی از شهروندان بطور غیرمنطقی هزینه نشود. اگر اجرای پروژه خلاف قانون باشد باید مراجع قانونی به مصوبات آن اعتراض کنند تا موضوع در دیوان اعدالت اداری بررسی شود.
حسینی پویا ادامه داد: تا پیش از اینکه مصوبات پروژه در مراجع قانونی ابطال نشده دستور توقف اجرای آن قابل قبول و منطبق با شیوه های قانونی نیست. پس مسئولیت کمیسیون ماده پنج و شورای عالی شهرسازی چیست که دادستانی در این خصوص ورود می کند. ورود به این پروژه در صلاحیت قوه مجریه است، دادستانی یا هیچ مرجع دیگری در قوه قضاییه نمی تواند کاربری زمین را تغییر دهد لذا از لحاظ حقوقی این ایراد را به دادستان مشهد داریم.
وی گفت: باید به تفکیک صلاحیتها از لحاظ حقوقی ملتزم باشیم، فصل الخطاب قانون است و باید به صلاحیتهای قانونی پایبند بود.
پروژه جاده کمربندی جنوبی مشهد به طول 27 کیلومتر از انتهای بلوار شهید برونسی در غرب مشهد تا اتوبان باغچه در شرق این شهر یکی از بزرگترین طرحهای شهرداری مشهد است. این پروژه شامل ساخت دو باند اصلی رفت و برگشت به عرض 13.8 متر، ۲۳ تقاطع همسطح و غیرهمسطح، هشت دستگاه دوربرگردان غیرهمسطح و پنج دستگاه پل راه روستایی است.
همچنین برای اجرای جاده کمربندی جنوبی مشهد باید دو میلیون و ۸۰۰ هزارمتر مکعب خاکبرداری و یک میلیون و ۵۰۰ هزارمترمکعب خاکریزی در حوزه ارتفاعات جنوبی این شهر انجام شود.
قرارداد پروژه جاده کمربندی جنوبی مشهد به صورت ۱۰۰ درصد غیرنقدی است به این معنا که در ازای اجرای آن، به پیمانکار مربوطه زمین و واحد تجاری واگذار می شود.

رئیس کمیسیون حقوقی شورای اسلامی شهر مشهد همچنین در پاسخ به پرسشی پیرامون استعفای یکی از اعضای شورای شهر گفت: تاکنون نامه استعفا از امیر شهلا دریافت نکرده ایم. اگر استعفایی انجام شود این درخواست باید در صحن علنی شورا بررسی و مشخص شود که ناشی از تصمیم آزاد بوده یا تحت فشار بیرونی و درونی است.
وی افزود: اگر تا آن زمان رای قطعی علیه عضو شورای شهر مشهد صادر و آن رای موجب سلب حقوق اجتماعی شود مطابق قانون عمل خواهیم کرد اما اگر از آرایی نباشد که منجر به سلب حقوق اجتماعی باشد تصمیم گیری متفاوت خواهد بود.
حسینی پویا ادامه داد: به لحاظ حرفه ای هیچکس از اتفاقی که در خصوص این عضو شورا افتاده طرفداری نمی کند اما نوع برخورد و اینکه حقوق شهروندی در خصوص وی رعایت شده یا نه، مهم بوده و توجه به این نکات هنگام تصمیم گیری ضروی است.
امیر شهلا سوم اردیبهشت گذشته به اتهام آنچه که مسائل مالی عنوان شده بود بازداشت و اوایل خرداد ماه جاری با قرار وثیقه آزاد شد.
