اعاده اموال نامشروع مسئولان
جمعی از نمایندگان مجلس شورای اسلامی طرح 2 فوریتی «اعاده اموال نامشروع مسئولان» را تهیه و تدوین نمودند.
به موجب این طرح، هیاتی متشکل از نهادهای نظارتی، امنیتی و قضایی وظیفه بررسی اموال مسئولان را دارد که پس از بررسیها درصورت حصول اطمینان از نامشروع این اموال، آنها را به بیت المال باز میگرداند.
نماینده مردم چناران و طرقبه شاندیز و عضو کمیسیون حقوقی و قضایی مجلس شورای اسلامی در گفتوگو با فارس در بیان جزئیات این طرح، گفت: باتوجه به اصل چهل و نهم قانون اساسی که مقرر داشته حکومت اسلامی موظف است ثروتهای غیرمشروع را گرفته و به صاحب حق رد کند.
محمد دهقان افزود: درصورت معلوم نبودن او به بیت المال بدهد و با توجه به دستورات دینی مفصلی که درباره برخورد با مفسدین وارد شده است و با عنایت به مقدمه قانون اساسی که هدف دولت اسلامی را رسیدن به روابط و مناسبات عادلانه حاکم بر جامعه میداند و با عنایت به اصل سوم قانون اساسی که حکومت اسلامی را موظف به مبارزه با کلیه مظاهر فساد و تباهی و رفع تبعیضات ناروا و ایجاد امکانات عادلانه برای همه در تمام زمینههای مادی و معنوی کرده است و با توجه به اینکه از سال 1380 که حکم هشت مادهای رهبری ابلاغ شده، شانزده سال گذشته و در دولتهای مختلف تاکنون مبارزه مؤثری با فساد صورت نگرفته است؛ اقدام به تدوین طرحی در راستای مبارزه با فساد کردهایم.
دهقان افزود: با عنایت به اینکه فیشهای نجومی و املاک نجومی و رانت خواری، مردم را که سرمایههای این نظام و انقلاب هستند از هر قشری از مبارزه با فساد مأیوس کرده است و با توجه به اینکه رکود و وضعیت بد اقتصادی بخشی از جامعه را با مشکلات اقتصادی جدی مواجه ساخته است و با توجه به آیه شریفه قرآن کریم که فرموده است «الذین یکنزون الذهب و الفضه و لا ینفقونها فی سبیل الله فبشرهم بعذاب الیم» لازم است اقداماتی ضروری در راستای مبارزه با فساد صورت پذیرد.
عضو کمیسیون حقوقی و قضایی مجلس همچنین گفت: نظر به مطالبه عمومی موجود در جامعه و با عنایت به اینکه بررسیهای ابتدایی نشان میدهد افرادی در ابتدای انقلاب هیچ مالی نداشته و امروز ثروتهای میلیاردی انباشته کرده اند لازم است اموال مسئولین به صورت دقیق مورد بررسی قرار گیرد. این امر از این جهت اهمیت ویژه ای پیدا میکند که برخی از این افراد از ابتدای انقلاب در مناصب دولتی و حاکمیتی بوده و علی القاعده باید در خدمت نظام اسلامی و با حقوق و مزایای کارمندی امرار معاش میکردهاند و وقت تجارت و اندوختن ثروت نداشته اند. این طرح در جهت حفظ حقوق عمومی، بازگرداندن اموال نامشروع به مردم و بازسازی اعتماد عمومی ملت به مسئولین با قید دو فوریت تدوین شده است.
دهقان با اعلام اینکه تاکنون بیش از 70 نماینده این طرح را به امضاء رساندهاند، اظهار کرد: این طرح دارای یک ماده واحده و 12 تبصره است که برطبق آن پیش بینی شده تا هیاتی مرکب از یک قاضی با ابلاغ از سوی رئیس قوه قضاییه، یک نماینده از معاونت بازرسی دفتر مقام رهبری با اذن ایشان، یک نماینده از سازمان بازرسی کل کشور، یک نماینده از وزارت اطلاعات، یک نماینده از سازمان اطلاعات سپاه پاسداران، رؤسای کمیسیونهای قضایی و حقوقی و اصل نودم قانون اساسی مجلس شورای اسلامی (به عنوان ناظر) تشکیل شود.
به گفته دهقان، این هیأت موظف است رأساً نسبت به بررسی اموال رؤسای قوای سه گانه و معاونان و مشاوران آنها، وزرا و معاونان آنها و استانداران و معاونان آنها و شهرداران شهرهای مراکز استانها و معاونان آنها از ابتدای پیروزی انقلاب اسلامی تاکنون اقدام کرده و چنانچه اموال هر یک از آنها، همسر و فرزندان آنها بیش از حد متعارف باشد، خواه تحصیل اموال غیرمتعارف آنها مربوط به دوران مسئولیت باشد یا با استفاده از موقعیت و اطلاعات دوران مسئولیت بعد از آن دوران اموالی را تحصیل کرده باشند، نسبت به ضبط و انتقال آنها به بیت المال صرفاً جهت اشتغال جوانان و فقرزدایی اقدام کند.
