راهکارهای پیشگیری از حادثه مهسا امینی

هر چند می دانیم این پرونده اولین پرونده ناشی از فوت در اثر سهل انگاری یا حتی قتل یک شهروند در ماموربت های پلیس (البته در این پرونده هنوز زوایای آن باز نشده و منتظر اعلام نتیجه دلیل فوت هستیم) در ایران و کشورهای دیگر نیست و آخرین آن هم نخواهد بود. مسلما بسیاری از پرونده‌های مشابه ارتکاب یافته و خانواده‌هایی داغدار شدند، ولی در فضای مجازی به‌دلایل متعدد منعکس نشده است. هر چند می دانیم این پرونده کاملا خاص و مشابه پرونده‌های دیگر نیست زیرا انسانی نه در هنگام ارتکاب یک جنایت بلکه کاملا بی گناه دستگیر می‌شود، بنا به اظهار مادر و برادرش و فیلم بازداشتگاه در هنگام دستگیری مانتوی بلند و محجب
بوده است. غم این حادثه بر روح مردم سنگینی می‌کند و همه مهسا را چون دختر و خواهر خود می‌دانند و این ظرفیت خوبی برای اصلاح رویه ها بجای لجبازی با مردم است:
اما بنا به وظیفه معلمی و وکالت دادگستری و عضو هیات منصفه، چند راهکار برای پیشگیری از حوادث مشابه را بیان می‌کنم .

۱) حجاب یک امر عرفی است و به فرهنگ خانواده ها و افراد بستگی دارد ؛حکومت در این امر کاملا فرهنگی امنیتی و به صورت چکشی دخالت نکند ؛بلکه با اولویت عفاف ؛حرکت فرهنگی انجام دهد.
۲) جرم انگاری در خصوص بدحجابی و حجاب اجباری جواب نداده است و آثار منفی نظیر این حادثه و سوء استفاده‌های متعدد از آن به وضوح دیده می‌شود تا حدی که صدای باحجابان را هم در آورده است.
۳) حاکمیت و مجلس شجاعت به خرج دهد و جرم‌زدایی را انجام و فنر فشرده برخورد با بدحجابی را رها کند، شاید در یک بازه‌ای کوتاه وضعیت حجاب به خاطر همین سخت گیری و لجبازی‌ها بدتر شود ولی مسلما تعادل به این حوزه بر می گردد. تجربه قبل انقلاب را داریم. ملت همان ملت‌اند. در خانواده‌ها همه نوع پوشش داشتیم و همه با هم زندگی و با هم مدارا می‌کردند و عبارت کسی را هم در قبر دیگری نمی‌گذارند و آیه لاتزر وازره وزر اخری هم مشهور بود .
۴) پلیس خدوم و دستگاه قضایی هم در این خصوص مظلوم واقع می‌شوند‌. آنان مجری قانون هستند و قانون تکلیف سختی برای آنان تعریف که هم توان و هم آبروی آنان با این ماموریت همانند جمع آوری ماهواره در معرض خطر است، موسسات فرهنگی هم در خواب راحت فرو رفته‌اند .
۵) هر چند قانون آیین دارسی کیفری ۱۳۹۲ قانون پیشرفته‌ای در حفظ حقوق متهمین است و خیلی از مواد آن به‌دلایل کمبود نیرو و امکانات پلیس رعایت نمی‌شود ولی در خصوص موضوع جلب و بازداشت موقت و بازداشتگاه‌ها نیاز به بازنگری دارد تا حادثه مشابه پیش نیاید‌. مثلا مجلس می‌تواند قاعده ای وضع کند تا در هنگام جلب، دستگیری و بازداشت پسران و دختران زیر سی سال در غیر جرایم خاص و امنیتی، پلیس مکلف باشد، بلافاصله موضوع را به پدر، مادر و یا همسر اطلاع دهد، بیماری یا عدم بیماری را سوال و امکان نظارت و تماس تصویری خانواده ها و وکلاء را فراهم شود.

باز هم مصیبتی دیگر از موضوع حجاب اجباری و گشت ارشاد

قوانین جزا بر اساس قاعده اهم و مهم تنظیم می‌شود و باید از فیلتر اصول مردم و عدم امکان راه و فرض دیگر، غیر از مداخله کیفری و نیز واقع‌گرایی اجتماعی و آثار اجتماعی مداخله کیفری بگذرد . در موضوع بدحجابی، استرس دستگیری، انتقال به ون پلیس و بردن به بازداشتگاه برای زنان جوان (حتی بقیه مردم ) تاوان خیلی سنگین و‌ سختی است و حتی اگر پلیس در تمام این مراحل با احترام هم برخورد کند و سوء استفاده‌ها و قانون شکنی‌های احتمالی را هم نادیده بگیریم، فشار و استرس آن بسیاربالا است‌. جرم هم از منظر قانونی در پایین‌ترین درجه مجازات یعنی درجه هشت قرار دارد، لطفا به زنان جوان که در جامعه ما هزاران مشکل دارند، استرس ندهید، اگر حتی برای یک نفر این اتفاق بیفتد، فاجعه است و مسئولیت شرعی و قانونی بزرگی دارد و به اعتبارنظام و پلیس خدشه وارد می‌کند، پس بس کنید، از همکار محترم‌مان دکترجلیل رحیمی جهان آبادی هم به‌عنوان حقوقدان تقاضای پیگیری جدی را داریم.
